行政规范性文件的识别

【摘要】:随着我国对行政规范性文件监管的日趋完善,从源头上保证了依法行政。但是,目前我国在法制统一上存有一个严重的问题——诸多行政公文制定主体为逃避监管而使得满足行政规范性文件构成要素的文件仍以普通行政公文形式公布。这不仅影响我国法治国家的建设、法治社会的实现以及法治政府的形成,而且不利于公民、法人或其他组织维护其合法权益。规制此类情况需要增加新的行政公文管理制度,在所有行政公文出台之前进行前置识别程序。行政公文的前置识别程序在行政规范性文件管理中称为行政规范性文件的识别。目前,我国学界与现行有效的立法性文件中并未对行政规范性文件的性质进行深入研究与详细规定,无统一的识别标准、未单独设置行政规范性文件识别程序,以及行政规范性文件的管理人员配置不合理等是行政规范性文件识别难以进行的最大障碍,解决这类问题迫在眉睫。行政规范性文件识别能否开展的首要因素在于识别标准,其由共同要素与差别要素共同构成,共同要素包含普遍约束力与反复适用性;差别要素则一般包括制定主体、程序合法、涉及公民权利义务中的一项或者多项要素。通过对现有识别标准分析与评价,取长补短,建立新的识别标准的基本框架,以增加我国规范性文件理论研究范围、促进行政规范性文件管理制度的完善。重构识别标准更是为了满足对行政规范性文件进行监管的需要、司法机关对行政规范性文件进行附带审查的需要、公民寻求救济的需要;达到规制我国行政公文不规范的情形,尽量减少甚至避免行政机关或者其他公权力机关制定具有行政规范性文件的实质的行政公文,却以非行政规范性文件的形式发布的情况的目的;为我国法制的统一,法治国家的建成、法治社会的建成、法治政府的实现提供条件。
[Abstract]:With the improvement of the supervision of administrative normative documents in our country, the administration according to law is guaranteed from the source. However, At present, there is a serious problem in the unification of the legal system in our country-many administrative document makers make the documents that satisfy the constituent elements of administrative normative documents to be published in the form of ordinary administrative documents in order to evade supervision. Affecting the construction of our country under the rule of law, The realization of a society ruled by law and the formation of a government ruled by law are not conducive to the protection of the legitimate rights and interests of citizens, legal persons or other organizations. The pre-identification procedure of administrative documents is called the identification of administrative normative documents in the management of administrative normative documents. The nature of administrative normative documents has not been thoroughly studied and detailed in Chinese academic circles and current effective legislative documents, there is no uniform identification standard, and the identification procedure of administrative normative documents has not been set up separately. And the unreasonable allocation of administrative normative documents is the biggest obstacle to the identification of administrative normative documents. It is urgent to solve this kind of problems. The most important factor for the identification of administrative normative documents is the identification standard. It consists of common elements and different elements, common elements include universal binding force and repeated applicability, and differential elements generally include the establishment of the subject, the procedure is legal, It involves one or more elements of the civil rights and obligations. By analyzing and evaluating the existing identification standards, we can learn from each other and establish the basic framework of the new identification standards, so as to increase the scope of theoretical research on the normative documents in our country. To promote the improvement of the administrative normative document management system. Reconstruction of the identification standard is to meet the need of the supervision of the administrative normative documents, the judicial organs to the administrative regulatory documents of the need for incidental review, citizens need to seek relief; To regulate the irregularities of administrative documents in our country, and to minimize or even avoid administrative documents with the substance of administrative normative documents formulated by administrative organs or other organs of public power, But the purpose of issuing in the form of non-administrative normative documents is to provide the conditions for the unification of the legal system, the establishment of a country ruled by law, the establishment of a society governed by law, and the realization of a government ruled by law.
