城管执法视角下北京市违法建设治理问题及对策建议研究

【摘要】：违法建设的治理工作一直以来都是城市管理的难点。一方面,违法建设对一个城市的环境和经济秩序产生严峻挑战,违法建设屡禁不止对城市的持续健康发展产生巨大阻碍。另一方面,根治违法建设困难,政府部门行政执法所引发的社会矛盾也容易引起社会各界的高度关注。随着人民对城市管理工作标准和要求的提高,北京市提出治理违法建设的细化要求,城管执法部门担负任务重大、责任艰巨,为有效遏制违法建设蔓延趋势,城管执法工作面临新的考验。在此背景下,如何理顺治理违法建设的相关法律法规、政策措施、执法程序,充分发挥城管执法部门的作用,如何尽量规避因法规制度壁垒带来的依据不足、程序繁琐、执行不力等情况,是北京市各级政府和有关部门亟待解决的问题。因此,有必要对城管执法部门查处违法建设的执法依据、执法程序、执行成效和问题进行系统的梳理和理论分析。本文主要运用公共管理理论、公共选择理论、交易成本理论,从梳理城管部门查处违法建设的职责、程序和现状入手,通过案例分析和问卷调查,评估违法建设治理成效,以北京市城管执法为例分析违法建设治理困境,最终从体制机制、法律法规、执法手段、配套政策四个层面提出城管执法视角下,北京市治理违法建设的建议。全篇以中央城市工作精神为指导思想,贯彻法治理念,在全国城市管理和执法体制改革不断推进的背景下,本文以城管执法理论与实践为依据,站在城市管理行政执法的视角上,有针对性的提出了破解北京市违法建设治理困境的具体措施,对提高城市管理行政执法的规范化、法治化水平,具有一定的现实意义。
[Abstract]:The administration of illegal construction has always been a difficult point in urban management. On the one hand, illegal construction poses a severe challenge to the environment and economic order of a city. Illegal construction is not only a huge obstacle to the sustainable and healthy development of the city. On the other hand, it is difficult to eradicate the illegal construction. The social contradictions caused by the administrative law enforcement by government departments are also liable to arouse great concern from all walks of life. With the improvement of the standards and requirements for urban management work, Beijing has put forward a detailed request for the illegal construction of governance. The law enforcement departments of urban management have a heavy task and arduous responsibilities. In order to effectively curb the spreading trend of illegal construction, the law enforcement work of urban management faces a new test. Under this background, how to straighten out the relevant laws, regulations, policies and measures of illegal construction, Law enforcement procedures, giving full play to the role of urban management law enforcement departments, and how to avoid as far as possible the insufficiency of the basis brought about by barriers to the laws and regulations, cumbersome procedures, weak enforcement and so on, are problems to be solved urgently at all levels of government and relevant departments in Beijing. It is necessary to systematically comb and analyze the law enforcement basis, law enforcement procedure, execution effect and problems of urban management law enforcement department. This paper mainly uses the theory of public management, the theory of public choice, the theory of transaction cost, the theory of public administration, the theory of public choice and the theory of transaction cost. Starting from combing the duties, procedures and current situation of the investigation and punishment of illegal construction by urban management departments, through case analysis and questionnaire investigation, to assess the governance effectiveness of illegal construction, taking Beijing urban management law enforcement as an example, to analyze the plight of illegal construction governance, and finally from the system and mechanism. Four levels of laws and regulations, law enforcement means and supporting policies are put forward in the perspective of urban management law enforcement. The whole article takes the spirit of central city work as the guiding ideology and carries out the concept of rule of law. Under the background of the reform of the national urban management and law enforcement system, this paper, based on the theory and practice of urban management law enforcement, stands in the perspective of urban management administrative law enforcement. This paper puts forward concrete measures to solve the plight of illegal construction in Beijing, which is of practical significance to improve the standardization and legalization of urban administration and law enforcement.
