城市交通中电动自行车的法律规范问题研究

【摘要】：近年来,电动自行车这一交通工具在全国范围内发展迅速,随之产生了各种社会问题,尤其以城市交通中的问题最为突出。为此,本文通过研究探讨,认为针对电动自行车进行适当的、全面的法律规范具有积极意义。其一,电动自行车作为合法的交通运输工具,驾驶人使用其出行就享有相应的路权,允许和保障其上路行驶既是对其权利的肯定,也是社会发展之所必须;其二,对电动自行车的法律属性进行恰当的定义,才能更好地对电动自行车进行高效而公平的行政规制,从而保证城市交通环境的和谐。本文主要分为四个部分:第一章,介绍目前我国电动自行车的使用概况,并且归纳总结目前我国对于电动自行车的法律规定,以及几大城市对电动自行车进行规范、规制的方式。第二章,分析目前我国电动自行车的行政规制存在的具体问题。其主要表现在以下四个方面:类型定位模糊、“全面禁行”措施欠缺公允性、行政管理过程欠缺体系性和连贯性、损害赔偿保障手段的缺失。第三章,反思电动自行车的法律属性,分析目前我国城市交通中电动自行车的法律规范体系存在的错误和漏洞,并探讨修订电动自行车法律定义、明确其机动车的法律属性的可行性和必要性。第四章，在上述章节的基础上，，提出规范我国电动自行车行政规制的构想。其一，重新规定电动自行车的定义及法律属性，并做好对旧的非机动车国标向新的机动车国标过渡的工作准备。其二，建立具有针对性的行政规制体系，全面覆盖电动自行车行业的各个环节；其三，根据既定法律法规与地方性制度规范，全面加强行政监管，对各种违法、违章行为不再姑息或拖延。结语，简要概括文章的问题、思考和建议，归纳总结出本文的中心思想。
[Abstract]:In recent years, with the rapid development of electric bicycle in the whole country, all kinds of social problems have arisen, especially in urban transportation. It is considered that it is of positive significance to carry out appropriate and comprehensive legal norms for electric bicycles. First, as a legal means of transportation, electric bicycles have the right of way when they are used. To allow and protect its driving on the road is not only the affirmation of its right, but also the necessity of social development. Secondly, the proper definition of the legal attributes of electric bicycle can better carry out efficient and fair administrative regulation of electric bicycle. In order to ensure the harmony of urban traffic environment, this paper is mainly divided into four parts: the first chapter, introduces the current situation of the use of electric bicycles in China, and summarizes the current legal provisions for electric bicycles in China. As well as several major cities to regulate and regulate electric bicycles. Chapter two, This paper analyzes the concrete problems existing in the administrative regulation of electric bicycle in our country at present. It is mainly manifested in the following four aspects: vague positioning of the type, lack of fairness in the measures of "total ban", lack of systematization and consistency in the administrative process, etc. The third chapter reflects on the legal attributes of electric bicycle, analyzes the errors and loopholes in the legal system of electric bicycle in urban traffic in China, and probes into the revision of the legal definition of electric bicycle. The fourth chapter, on the basis of the above chapters, puts forward the idea of standardizing the administrative regulation of electric bicycle in China. First, it redefines the definition and legal attribute of electric bicycle. And to prepare for the transition from the old non-motor vehicle national standard to the new motor vehicle national standard. Second, to establish a targeted administrative regulation system to cover all aspects of the electric bicycle industry; third, According to the established laws and regulations and the local system norms, the administrative supervision should be strengthened in an all-round way, and all kinds of violations of laws and regulations will no longer be tolerated or delayed. Conclusion, briefly generalizing the problems, thinking and suggestions of the article, and summing up the central idea of this article.
