【摘要】:本文的研究以十八届三中全会全面深化改革以来关于宅基地使用权改革的精神为出发点,对宅基地现行相关制度、存在的问题进行系统整理分析,并阐述了宅基地转让的必要性和可行性,归纳各地的宅基地试点改革的成果,提出宅基地使用权立法的基本思路。按照基本思路提出宅基地转让立法的具体建议、宅基地转让现行法律制度修改建议、宅基地转让立法建议条文。本文第一部分介绍了宅基地现状问题。认为宅基地使用权存在:大量长期闲置且隐形交易;宅基地房屋买卖冲突纠纷;宅基地财产性权能不足;宅基地人在买卖、出租、抵押、继承和赠与等方面是受到诸多限制;宅基地及房屋所有权不动产登记;宅基地取得制度不健全;宅基地立法不完善等。第二部分的前半部分分析了宅基地转让改革的必要性。宅基地转让有利于"农民",有利于政府,有利于城乡一体化发展和有利于提升宅基地资源市场配置效率。第二部分的后半部分则从保障农民住房财产权,集体经营性建设用地与国有土地同权同价,宅基地抵押,户籍城乡统一等方面分析了国家深化农村土地制度改革思路。并系统梳理总结国内各地宅基地试点成果,提出宅基地转让改革具有可行性。本文第三部分,提出宅基地转让基本思路,并从宅基地转让主体等6个方面提出宅基地转让立法的具体建议。最终提出宅基地转让现行法律制度修改完善建议和宅基地转让立法建议条文。本文第四部分为结语,概要归纳本篇文章的论点,并提出展望。
[Abstract]:Based on the spirit of the reform of homestead use right since the third Plenary session of the 18th CPC Central Committee, this paper makes a systematic analysis of the existing system and existing problems of the homestead system.It also expounds the necessity and feasibility of the homestead transfer, sums up the results of the pilot reform of the homestead in various places, and puts forward the basic ideas of the legislation of the right to use the homestead.According to the basic ideas, this paper puts forward the specific suggestions on the legislation of homestead transfer, the amendment of the current legal system of homestead transfer, and the provisions of the legislative proposal on homestead transfer.The first part of this paper introduces the current situation of homestead.The author thinks that the right to use the homestead exists: a large number of long-term idle and invisible transactions; the disputes over the purchase and sale of homestead houses; the insufficient power of the property of the homestead; the limitation of the homestead people in buying and selling, renting, mortgaging, inheriting and donating;Real estate registration of homestead and house ownership; imperfection of Homestead acquisition system; imperfect legislation of Homestead.The first half of the second part analyzes the necessity of the reform of homestead transfer.The transfer of homestead is beneficial to the farmers, the government, the development of urban and rural integration and the efficiency of the allocation of homestead resources in the market.The second part of the second part of the second part from the protection of farmers' housing property rights, collective construction land and state-owned land with the same price, homestead mortgage, the unity of urban and rural household registration and other aspects of the country to deepen the reform of rural land system ideas.And systematic summary of domestic homestead pilot results, homestead transfer reform is feasible.In the third part, the author puts forward the basic idea of homestead transfer, and puts forward some concrete suggestions on the legislation of homestead transfer from six aspects, such as the subject of homestead transfer.Finally put forward the current legal system of homestead transfer to amend and improve the legislative provisions of homestead transfer.The fourth part of this paper is the conclusion, summarizes the argument of this article, and puts forward the prospect.
