不动产冒名处分的法律效力研究

【摘要】:不动产冒名处分处于与无权处分、无权代理似是而非的游离状态,其处理涉及无权处分、善意取得以及表见代理制度中一直存在且未曾解决的难点问题,由此也引发了理论与实践中的争议。此种争议主要集中在两个方面:是否应优先保护买受人的善意信赖;如果保护,应选用何种制度。通过价值判断以及理论分析,冒名处分行为不应作为民法上的违法与无效行为对待,受让人的利益应该得到优先于名义人利益的保护。经比较,不动产善意取得制度过于僵化且不应适用于不动产冒名处分,类推适用无权代理比较合适。不动产物权静的安全与动的安全同样重要,忽视任何一方都会导致严重的社会问题,应以公平的标准合理权衡两者的比重。在无权代理的具体适用过程中,应结合被冒名人的可归责性程度与受让人的信赖程度、可归则性等进行动态的判断。
[Abstract]:The disposition of impersonation of immovable property is in the dissociative state of disposition and unauthorized disposition, and the disposition involves the difficult problems which have not been solved in the system of unauthorized disposition, bona fide acquisition and apparent agency. This has also led to controversy in theory and practice. This dispute mainly focuses on two aspects: whether the buyer's good faith should be protected first, and if so, what system should be chosen. Through value judgment and theoretical analysis, the act of impersonating punishment should not be treated as an illegal or invalid act in civil law, and the interests of transferee should be given priority over the protection of the interests of the nominal person. By comparison, the system of bona fide acquisition of immovable property is too rigid and should not be applied to the disposition of impersonation of immovable property. The security of immovable property right is as important as the safety of moving property. Neglecting any party will lead to serious social problems, so we should weigh the proportion of the two according to the fair standard. In the concrete application process of unauthorized agent, dynamic judgment should be made on the basis of the impersonated person's degree of imputation, the degree of trust of transferee, the degree of reducibility and so on.
