【摘要】：伴随社区矫正各项事业快速推进,社区矫正法律监督体系在实践中也暴露出监督力度不足、监管困难等问题,严重阻碍我国社区矫正事业的顺利发展,影响了法治国家建设大局。如何破解法律监督实践难题,完善社区矫正法律监督体系对我国矫正工作展开,促进其公正、合法发展有重大意义。本文以我国当前监督制度现状进行实证分析,基于检察机关监督权出发,指出现有制度在我国实施的总体现状以及实践困境;并介绍西方发达国家社区矫正监督制度的有效经验,在此基础上,对我国当前面临的监督难题,完善当前社区矫正监督体系做出几点建议。本文以理论概述、问题现状、域外情况到解决问题这一思路,共分四个部分来详细叙述。具体来说:第一部分:具体介绍本文研究的目的以及意义性。简单概述社区矫正及其法律监督的主体和对象、方式和内容以及该制度的意义性,为下文详细阐述做理论铺垫。第二部分:首先分析了我国现有社区矫正法律监督立法现状。其次对我国社区矫正法律监督实践状况做了概述,指出我国社区矫正法律监督成效不足、监督滞后、人员消极等现状。再次,以江苏省、安徽省和上海市检察实践为代表,阐明国内社区矫正法律监督的新发展。最后,指出并详细分析我国社区矫正监督体系中的监管难点、困境以及问题。第三部分:是对域外法律监督机制的分析,分别概述了美国、英国和日本的社区矫正法律监督制度,并概括出其社区矫正检察重视审前调查评估、法律法规完善和注重人权保护的特点。第四部分:通过前文分析,借鉴国外经验,对我国社区矫正法律监督制度中的问题及困境提出了完善法律法规、构建相关司法制度、重视运用科技方式进行监督以及提高监督者自身能力和建立监督问责机制等建议来完善社区矫正法律监督机制。
[Abstract]:With the rapid advancement of community correction, the legal supervision system of community correction has also exposed some problems, such as insufficient supervision and difficult supervision, which seriously hinder the smooth development of community correction in our country. Affected the overall situation of building a country ruled by law. How to solve the practical problems of legal supervision and how to perfect the legal supervision system of community correction are of great significance to the rectification work of our country and promote its fair and legal development. Based on the analysis of the current situation of supervision system in China, this paper points out the overall situation and practical difficulties of the implementation of the existing system in our country based on the supervisory power of the procuratorial organ. On the basis of introducing the effective experience of community correction supervision system in western developed countries, some suggestions are made to improve the current community correction supervision system. In this paper, a theoretical overview, the status quo of the problem, the extraterritorial situation to solve the problem this train of thought, a total of four parts to describe in detail. The first part introduces the purpose and significance of this paper. The main body and object, method and content of community correction and its legal supervision, as well as the significance of the system, are briefly summarized, which pave the way for the detailed elaboration of the following theory. The second part: firstly, it analyzes the current legislation status of community correction legal supervision in our country. Secondly, the author summarizes the practice of legal supervision of community correction in China, and points out that the legal supervision of community correction in our country is not effective enough, the supervision lags behind, and the personnel are negative. Thirdly, taking the procuratorial practice of Jiangsu, Anhui and Shanghai as the representative, this paper clarifies the new development of the legal supervision of community correction in China. Finally, the difficulties, difficulties and problems in the supervision system of community correction in China are pointed out and analyzed in detail. The third part is an analysis of the extraterritorial legal supervision mechanism, which summarizes the legal supervision system of community correction in the United States, Britain and Japan, and summarizes the importance of pretrial investigation and evaluation in the community correction prosecution. Perfect laws and regulations and pay attention to the characteristics of human rights protection. The fourth part: through the previous analysis, drawing on the experience of foreign countries, the problems and difficulties in the legal supervision system of community correction in our country are put forward to perfect the laws and regulations, and build the relevant judicial system. To improve the legal supervision mechanism of community correction, we should pay attention to the suggestions of using scientific and technological methods to supervise and improve the supervisor's own ability and establish the supervision and accountability mechanism.
