法律原则在我国司法实践中的适用研究

【摘要】：近些年来,因为海外学者对法律原则的研究不断深入,再加上海内政治经济的发展,新鲜事物的层出不穷,人们自我认识的不断苏醒,故而在司法实践中仅凭一般的法律规则有时很难作为法官定案的依据,更别提较好的保障当事人的公道公正,由此法律原则就一步一步的走入了人们的视线,作为法官裁判的依据。恰是有鉴于此,法律原则适用的研究对于我国司法实践而言是具有极为重要的理论与实践意义的。本文从法律原则的概述出发,描述了当前我国司法实践中法律原则的适用思路,进一步分析了法律原则适用的情况,并运用司法判例将理论与实践相结合进行分析,最后对于我国法律原则司法适用的问题提出了自己的完善方法给予参考。
[Abstract]:In recent years, because overseas scholars' research on legal principles has been deepening, coupled with the development of domestic politics and economy, new things have emerged one after another, and people's self-knowledge is constantly reviving. Therefore, in judicial practice, it is sometimes difficult to rely on general legal rules as the basis for a judge to decide a case, let alone to ensure justice and fairness of the parties, thus the principle of law has entered people's attention step by step. As the basis for a judge's decision. In view of this, the study of the application of legal principles is of great theoretical and practical significance to our judicial practice. Starting from the summary of legal principles, this paper describes the application of legal principles in our country's judicial practice, further analyzes the application of legal principles, and analyzes the combination of theory and practice with judicial precedents. Finally, the author puts forward his own perfect methods for the judicial application of legal principles in our country.
