【摘要】：从古至今,生育都是人类繁衍生息最主要的途径,不言而喻,伴随人类的繁衍,文明的进步,人类的生育观念也在不断的变更。在我国,生育观念一直以婚姻家庭关系为依托,婚姻成为了生育的前提和保障,在普世的观念上,生育只有在婚姻条件下才为法律和道德承认。然而当今社会,女性社会地位得到提高,社会角色发生重大转变,去婚姻化的观念正在蔓延。与此同时,女性权利意识也在逐步的提高,近些年女性权利在法律以及道德上也引起越来越多重视,生育权作为一项基本人权一直为学界关注。伴随女性思想的解放,生活方式的改变,越来越多的独身女性渴求生育权得到保障,希望生育权可以摆脱婚姻和家庭的束缚,能够得到法律和社会支持。然而面临传统伦理道德和法律政策等因素的阻碍,独身女性生育权被认可和保护仍有很长的一段路要走。本文通过历史分析方法、法解释学研究方法和比较分析方法,了解西方独身女性保护状况,正视我国法律保障的缺失,合理的、完整的论证了独身女性生育权相关内容。具体包括:界定独身女性的涵义和范围,分析生育权的性质和内容,充分论证生育权作为基本权利的正当性,通过对独身女性生育权质疑的反驳,坚持独身女性应该具有生育权的论断。再以上论证的基础上,本文提出了独身女性生育权实现的保障和制度设计,全方位论述了独身女性生育权实现的路径、障碍和整体运行机制。制度上的设计一定要有法律上的依托,本文就独身女性生育权的法律规定进行梳理,在此基础上提出以宪法保障为核心部门法协调补充的权利保障体系构想,希望能够切实的保障独身女性生育权的实现。
[Abstract]:From ancient times, fertility is the most important way of human reproduction, it is self-evident, with the human reproduction, civilization progress, the concept of human fertility is constantly changing. In our country, the concept of fertility has always been based on marriage and family relations, marriage has become the premise and guarantee of fertility. In the universal concept, fertility is only recognized by law and morality under the condition of marriage. However, in today's society, the social status of women has been improved, social roles have changed significantly, and the concept of dismarriage is spreading. At the same time, the awareness of women's rights is also gradually improving. In recent years, women's rights have attracted more and more attention in law and morality. As a basic human right, reproductive rights have always been concerned by scholars. With the emancipation of women's thoughts and the change of their way of life, more and more celibate women yearn for the protection of their reproductive rights, hoping that they can get rid of the bondage of marriage and family and get legal and social support. However, in the face of the obstacles of traditional ethics and legal policies, there is still a long way to go before single women's reproductive rights are recognized and protected. Through historical analysis method, legal hermeneutics research method and comparative analysis method, this paper understands the situation of western celibate women's protection, faces the lack of legal protection in our country, reasonably and completely demonstrates the related contents of celibate women's reproductive right. It includes: defining the meaning and scope of celibate women, analyzing the nature and content of reproductive rights, fully demonstrating the legitimacy of reproductive rights as basic rights, and refuting the doubts of single women's reproductive rights. The assertion that celibate women should have reproductive rights. On the basis of the above argument, this paper puts forward the guarantee and system design of the realization of single woman's reproductive right, and discusses the path, obstacle and the whole operating mechanism of the realization of single woman's reproductive right in all directions. The design of the system must be based on the law. This paper combs the legal provisions of the reproductive rights of single women, and on this basis puts forward the idea of the rights guarantee system which is coordinated and supplemented by the constitutional protection as the core branch law. I hope to be able to ensure the realization of single women's reproductive rights.
