论刑法中的极端主义

【摘要】：《刑法修正案(九)》、《反恐怖主义法》公布实施以后,极端主义行为被纳入到法律的规制范围。一方面暴恐案件的新情况、新问题使得原有的法律弊端凸显,另一方面为了构建更加全面的保护国家安全、社会安全的法律体系,协调《国家安全法》、《反恐怖主义法》相关内容。因此,极端主义行为之所以"入刑",可以归结为两点,一是司法现实的需要,二是立法体系协调的要求。刑法是保护社会的最后一道防线,刑法既不能缺位也不能越位。解释刑法中的极端主义是正确适用刑法、《反恐怖主义法》相关内容的基础。刑法中的极端主义应当定义为:以宗教信仰、民族事务为掩饰,宣扬可能导致危害公共安全(不特定或者多数人的生命、身体的安全以及公共生活的平稳与安宁)行为的思想体系。刑法中的极端主义犯罪解释必须要围绕着极端主义的概念进行,一方面以此概念作为判断极端主义行为罪与非罪、此罪与彼罪的标准,另一方面以此概念为基础对于极端主义犯罪的构成要件进行解释。国际与国内环境面临着严重的恐怖活动危机,这种危机一方面体现为暴恐活动的广泛性、多样性、频繁性。另一方面体现为暴恐活动所带来的次生影响,比如对社会生活秩序、地区或国家安全形势、民众心理产生的不良影响。在这种背景下,对极端主义行为的规制要坚持以极端主义概念为核心,行政法优先适用,保护宗教信仰、民族权利,坚持社会综合治理的原则,把严厉打击和综合治理相结合,标本兼治的同时也要防止重走"严打"的错路。
[Abstract]:After the promulgation and implementation of the Anti-Terrorism Law, extremism was brought into the scope of the law. On the one hand, the new situation of violent terrorism cases and new problems have highlighted the original legal drawbacks, on the other hand, in order to build a more comprehensive legal system to protect national security and social security, Coordinate the contents of the National Security Act and the Anti-Terrorism Act. Therefore, the reason why extremist acts "criminal" can be summed up as two points, one is the need of the judicial reality, the other is the need for the coordination of the legislative system. Criminal law is the last line of defense to protect society. Criminal law can neither be absent nor offside. The interpretation of extremism in the criminal law is the basis for the proper application of the criminal law and the relevant contents of the Anti-Terrorism Law. Extremism in criminal law should be defined as: propaganda, disguised as religious beliefs, ethnic affairs, that could result in endangering public safety (not specific or majority lives), A system of thought for physical safety and for the smooth and peaceful conduct of public life. The interpretation of extremist crimes in criminal law must be carried out around the concept of extremism. On the one hand, the concept is regarded as the criterion to judge the crime of extremism and the crime. On the other hand, on the basis of this concept, the elements of extremist crime are explained. The international and domestic environment is faced with a serious crisis of terrorist activities, which on the one hand embodies the universality, diversity and frequency of violent terrorist activities. On the other hand, it reflects the secondary influence brought by violent terrorist activities, such as the bad influence on social order, regional or national security situation and people's psychology. Under this background, we should insist on the concept of extremism as the core of the regulation of extremism, give priority to the application of administrative law, protect religious beliefs, national rights, adhere to the principle of comprehensive social governance, and combine severe crackdown with comprehensive governance. At the same time, it is necessary to prevent the wrong way of "strike hard" again.
