中国食品安全综合治理法治化途径探讨

【摘要】：食品安全相关的负面新闻时常出现已经成为影响民众幸福感的因素之一,我国食品安全问题因其普遍多发成为社会一项重要热点而受到关注。理论界对此也有较多研究,但总体研究较为分散,不能有效的解决现实中的复杂性问题。为治理食品安全问题,我国制定了一系列法律,食品安全监管部门也加大了执法的力度,但食品安全问题仍然呈现出总体增长的趋势,为此,要反思食品安全屡禁不止的原因。食品安全问题错综复杂,从实践过程中可以看出仅仅依靠食品监管部门一方的力量是远远不够的,对食品安全的监管和治理是一个需要各方共同努力,共同治理。国外欧美发达国家在食品安全治理上,探索出相对比较完善的经验,基于食品安全问题的共性,这些经验可以为我国治理食品安全问题提供有益的借鉴。结合我国食品安全治理的实际以及国外食品安全治理过程中的先进经验,在综合治理的过程中需要对一些行之有效的制度法治化。通过法治化提供一个综合治理的平台。总体来说,要从食品生产经营企业本身入手,建立起良性成长的信用和信誉体制,加强内部监督。在此基础上,还要形成公众参与的外部监督体系,而信息公开是公众参与的必要条件。食品安全监管部门作为监管的重要一方,也要探索新的治理模式,而食品安全预防及强制保险制度是适应时代发展的有效方式。最终,如果不能给予受到食品安全问题侵害的民众以救济,则任何制度就会成为一纸空文,所以要确保民众救济制度的落实。总之,对食品安全进行治理是一个系统性的工程,是要运用综合手段对其进行规制,并将这些综合手段上升到法律的层次,通过制度化的良性运营,利用法律的功能从而有效解决食品安全问题。
[Abstract]:Negative news about food safety has often become one of the factors that affect the well-being of the public. Food safety issues in China have attracted attention because of their frequent occurrence as an important social hot spot. There are many researches on this in the theoretical circle, but the overall research is scattered, which can not effectively solve the complexity problem in reality. In order to solve the food safety problem, China has made a series of laws, and the food safety supervision department has also strengthened the law enforcement, but the food safety problem still presents the general increasing trend, therefore, we should reflect on the reason why the food safety is forbidden repeatedly. The problem of food safety is complicated. From the practice, we can see that it is far from enough to rely on the strength of the food supervision department, and the supervision and management of food safety is a need for the joint efforts of all parties. Based on the commonness of food safety problems, the foreign developed countries in Europe and the United States have explored relatively perfect experience in food safety management. These experiences can provide useful reference for our country to deal with food safety problems. Combined with the practice of food safety management in our country and the advanced experience in the process of food safety management in foreign countries, it is necessary to rule by law some effective systems in the process of comprehensive management. Through the rule of law to provide a comprehensive governance of the platform. In general, we should start with the food production and management enterprises, establish a sound credit and credit system, and strengthen internal supervision. On this basis, the external supervision system of public participation should be formed, and public information is the necessary condition of public participation. As an important part of the supervision, the food safety supervision department should also explore the new management mode, and the food safety prevention and compulsory insurance system is an effective way to adapt to the development of the times. In the end, if people who have been harmed by food safety can not be given relief, any system will become a dead letter, so we should ensure the implementation of the public relief system. In a word, it is a systematic project to regulate food safety by using comprehensive means to regulate it, and to raise these comprehensive measures to the level of law and to run them in a sound and institutionalized manner. Make use of the function of law to solve food safety problem effectively.
