我国网约车准入规范研究

【摘要】:作为互联网经济下的新兴行业,网络预约出租汽车(以下简称“网约车”)自兴起以来一直饱受争议。2016年7月,国务院七部委联合出台《网络预约出租汽车经营服务管理暂行办法》,网约车合法化的时代到来。合法性问题解决之后,当前网约车准入规范值得关注。我国网约车准入这一行政行为在性质上属于行政许可。从行政许可法的视角考察,国务院部委以部门规章设定行政许可不合法;要求驾驶员、车辆和平台均须取得许可证的规定,基本沿用传统出租车的准入制度,许可范围过大。对于地方出台的网约车准入规范,存在地方政府规章增设行政许可条件、许可条件过于严苛、关于户籍车型的不当限制违反比例原则等问题。基于目前网约车准入规范的问题,对网约车准入设立行政许可,应首先完善法律位阶,制定地方政府规章上位法,交由国务院制定行政法规作为法律依据,当前可由国务院采用发布决定的方式进行规范。在具体准入方式上,设计“政府管平台,平台管人和车”的模式,保留对网约车平台的许可,取消对网约车辆和驾驶员的行政许可。在准入条件上,降低准入门槛,激发网约车市场活力。
[Abstract]:As a burgeoning industry in the Internet economy, online taxi booking has been controversial since its rise. In July 2016, Seven ministries and commissions of the State Council jointly issued the interim measures for the Management of Network booking Taxi Business Service, the era of legalization of network ride-hailing came. After the legality problem is solved, the current network ride-hailing admittance standard is worth paying attention to. In our country, the administrative behavior of entering into the net car is administrative license in nature. From the perspective of the administrative license law, the ministries and commissions of the State Council set the illegal administrative license by departmental regulations; required drivers, vehicles and platforms to obtain permits, and basically followed the traditional taxi access system, and the scope of permission was too large. There are some problems such as adding administrative license conditions to local government rules and regulations, too strict licensing conditions, improper restrictions on household registration models and so on. In view of the problem of the current regulations for the access to the net car, the establishment of the administrative license for the access to the net charter car should first perfect the legal rank, formulate the upper law of the local government regulations, and hand it over to the State Council to formulate the administrative regulations as the legal basis. At present, the State Council may adopt the method of issuing decisions to regulate. In the specific access mode, the "government management platform, platform management and vehicle" mode is designed to retain the license to the net-chartering platform and cancel the administrative license for the net-contracted vehicle and driver. In the access conditions, reduce the entry threshold, stimulate the market vitality.
