法治国家建设的“中国特色”研究

【摘要】：党的十八届四中全会通过《关于全面推进依法治国若干重大问题的决定》,提出全面依法治国的基本方略,体现了党对法治的认识达到了新的高度,也是解决法治进程中现实问题的需要,确立依法治国理念刻不容缓。没有革命的理论就不会有革命的运动。全面推进依法治国,需要一系列更科学、更全面、更贴近当代中国社会实际相关理论的指导。而这样一套理论,需要我们从社会主义法治建设的伟大实践中去总结、去凝练、去升华。本文立足中国国情、社情、民情,尝试从理清法治国家基本内涵入手,紧紧围绕马克思主义经典作家关于法治国家建设的相关论述,梳理分析出法治国家建设的构成要素,同时借鉴中西法治国家建设的特色及经验,研究我国法治国家建设的鲜明特色。法治国家,即国家权力,特别是行政权力必须依照法律行使的国家。马克思主义经典作家关于社会主义政权建设及法制建设的论述为我国法治国家建设提供了科学理论指导。建设法治国家,一要有成熟稳固的现代民主政治制度;二要有完善健全的法律体系;三要有科学化、规范化、廉洁化的国家机构设置。而新型的政治体制、中国共产党的领导、健全的法律体系、政府依法行政、独立公正的司法体制则是建设中国特色社会主义法治国家必不可少的条件。此外,对于西方法治国家的建设实践,我们应该坚持马克思主义政党的开放品质,大胆的批判,批判的继承,剔除糟粕,汲取精华,为中国特色社会主义法治国家建设提供有益借鉴。
[Abstract]:The fourth Plenary session of the 18th CPC Central Committee adopted the "decision on comprehensively promoting the ruling of the country according to Law," and put forward the basic strategy of comprehensively governing the country according to law, which reflects the Party's new understanding of the rule of law. It is also the need to solve the practical problems in the process of rule of law, and it is urgent to establish the idea of governing the country according to law. There can be no revolutionary movement without revolutionary theory. To comprehensively promote the rule of law, we need a series of more scientific, more comprehensive, closer to the relevant theories of contemporary Chinese society. Such a theory requires us to sum up, refine and sublimate from the great practice of socialist legal construction. Based on China's national conditions, social conditions and people's feelings, this paper tries to clarify the basic connotation of a country ruled by law, closely revolves around the relevant exposition of Marxist classic writers on the construction of a country ruled by law, and analyzes the elements of the construction of a country ruled by law. At the same time, draw lessons from the characteristics and experience of the construction of the country ruled by law, study the distinctive characteristics of the construction of the country ruled by law. A country ruled by law, that is, a country where state power, especially administrative power, must be exercised in accordance with the law. The exposition of Marxist classical writers on the construction of socialist regime and legal system provides scientific theoretical guidance for the construction of our country ruled by law. To build a country ruled by law, it is necessary to have a mature and stable modern democratic political system, a sound legal system, and a scientific, standardized and clean state institution. The new political system, the leadership of the Communist Party of China, the sound legal system, the administration by law of the government and the independent and impartial judicial system are the indispensable conditions for building a socialist country ruled by law with Chinese characteristics. In addition, with regard to the practice of building a country ruled by law in the West, we should adhere to the open quality of Marxist political parties, boldly criticize, critically inherit, remove the dross and absorb the essence. To provide a useful reference for the construction of a socialist country ruled by law with Chinese characteristics.
