利益平衡视角下对创意的法律保护

【摘要】: 广告、时装设计、建筑、艺术、工艺品、工业设计、音乐、表演艺术、出版、软件、电视、广播属于创意产业。这些行业的特点是在基于价值链的知识创造活动中,创意本身(如广告策划、商业策划、剧本故事情节梗概)比创造过程的表达(比如具体的服装设计图案、广告图案、剧本文字作品)具有更大的价值。 传统著作权法按思想与表达二分原则来保护智力创造活动的成果。智力活动成果若属表达范畴,则受到著作权法的保护,若属创意范畴,则不受它的保护。这种立法上的缺失导致我国电视节目创意、广告策划方案等克隆成风,严重影响了创意人的创造热情,干扰了正常的市场竞争秩序。此外,现有其它法律对创意的保护也是不够充分的。 本文从利益平衡的角度,从理论和实践两方面探讨创意的法律保护方法。 首先,本文从创意的概念、特征和存在形态入手,分析它与思想、内容和表达的关系,以及它与作品、专利、商标和商业秘密的区别,将创意的概念界定为具有新颖性、具体性和尚待实践性主意或想法。 其次,本文从澄清围绕创意保护而产生的利益关系出发,从法理学和法哲学的角度,论证了创意利益受保护的合理性,并运用知识产权利益平衡原理,探索创意保护利益平衡机制的构建思路。 再次,借鉴美国的司法判例,论述了创意保护的非产权方法和产权方法,包括明示合同、默示合同、准合同、竞争法和财产权保护方法。并运用知识产权利益平衡原理对这些方法进行了比较分析,得出创意的产权保护、尤其是特殊权利保护模式是创意法律保护的最佳进路的结论。 最后,借鉴我国现行《著作权法》和其它知识产权法的相关规定,从利益平衡的角度,从权利授予与权利限制两方面对创意特殊权利,即创意权进行了初步设计。本文还通过对“纳代尔”案进行评述,对实践中创意的法律保护方式的选择和创意的侵权判断进行了探讨。对侵权判断中可接触性原则及相关的“公开的相对性”进行了诠释。
[Abstract]:Advertising, fashion design, architecture, art, crafts, industrial design, music, performing arts, publishing, software, television, radio belong to creative industries. Creativity itself (such as advertising, business planning, storyline sketches) is more valuable than the expression of creative processes (such as specific clothing design patterns, advertising patterns, screenplay text works). The traditional copyright law protects the achievements of intellectual creative activities according to the principle of dichotomy of thought and expression. If intellectual activities belong to the category of expression, they are protected by copyright law, if they belong to the category of creativity. This lack of legislation has led to the cloning of creative television programs and advertising schemes in China, which has seriously affected the creative enthusiasm of creative people and interfered with the normal order of market competition. Other existing laws do not protect ideas sufficiently. From the angle of interest balance, this paper discusses the legal protection method of creativity from two aspects: theory and practice. First of all, this article starts with the concept, characteristic and existence form of creativity, analyzes its relationship with thought, content and expression, as well as its difference from work, patent, trademark and trade secret, and defines the concept of creativity as having novelty. A concrete and yet practical idea or idea. Secondly, from the point of view of jurisprudence and legal philosophy, this paper demonstrates the rationality of the protection of creative interests, and applies the principle of balancing the interests of intellectual property rights to clarify the relationship between the interests generated by the protection of creativity, and from the perspective of jurisprudence and philosophy of law. Explore creative protection of the interests of the balance of the construction of ideas. Thirdly, referring to the judicial precedents of the United States, this paper discusses the non-property rights methods and methods of creative protection, including express contract, implied contract and quasi-contract. The methods of competition law and property right protection are compared and analyzed by using the principle of balance of intellectual property rights, and the conclusion is drawn that the protection of creative property right, especially the special right protection mode, is the best way to protect creative law. Finally, drawing lessons from the relevant provisions of China's current copyright Law and other intellectual property laws, from the angle of balance of interests, from two aspects of right grant and right limitation to creative special rights, That is, the creative right is preliminarily designed. This paper probes into the choice of legal protection of creativity in practice and the judgment of infringement of originality, and interprets the principle of accessibility and the relative "open relativity" in the judgment of tort.
