商品房预售合同研究

【摘要】: 本文针对商品房预售行为的特殊性,以合同法的相关理论为视角分析了商品房预售合同与认购书的关系、研究了商品房预售合同条款及其完善,并对相关的司法解释条文进行了评析。本文还针对易发生的商品房预售合同的五类纠纷即房地产销售广告、商品房交付、建筑面积、质量、装饰装修纠纷进行了分析。针对不同的纠纷,运用我国现行法律探讨了解决此类案件的裁判思路,同时也对部分立法的缺失提出了完善的建议,以期对商品房预售合同理论构建及审判实务有所裨益。
[Abstract]:In view of the particularity of the pre-sale behavior of commercial housing, this paper analyzes the relationship between the pre-sale contract of commercial housing and the acceptance of the book from the perspective of the relevant theory of contract law, and studies the terms and consummation of the pre-sale contract of commercial housing. And the relevant judicial interpretation of the provisions of the evaluation. This paper also analyzes five kinds of disputes in the presale contract of commercial housing, that is, real estate sales advertisement, delivery of commercial housing, building area, quality, decoration and decoration. In the light of different disputes, this paper probes into the judicial thinking of solving this kind of cases by using the current law of our country, and at the same time puts forward some perfect suggestions for the lack of some legislation, in order to benefit the construction of the theory of the pre-sale contract of commercial housing and the trial practice.
