【摘要】:随着商业活动的发达,媒体传播及广告设计的日新月异,现今人们所能认知的能够构成商标的标志已不仅仅限于文字或简单图形了,很多视觉上能够感知的标志,能够把自己经营的商品和别人的商品区别开来的标识,都是具有商标潜力的。和众多新型商标一样,颜色正在成为消费者识别商品的一种重要方式,鉴于颜色对于商标有一定的作用及重要性,本文具体讨论以颜色作为商标形式,并且是以单一颜色作为商标的法律保护问题。世界各国的商标法制度对于单一颜色这个问题规定不一,如我国商标法的规定虽然已打破了传统商标注册标准,对于颜色组合商标已给予明文保护,但是对于单一颜色可否作为商标的规定仍然是模糊的,本论文欲以首个保护单一颜色商标的美国法律为主轴,引进美国立法概念浅析单一颜色商标的法律保护发展的进程及现状,结合案例透析单一颜色商标如何得到注册保护,并且设想了单一颜色商标可能产生的侵权问题,结合驰名商标制度可能产生的法律问题,总结单一颜色商标获得注册之后的几项法律保护规则。笔者留美攻读法学硕士期间通过案例式学习以及对于美国1946年联邦商标法等成文法的学习,对商标法中若干特别问题的研究有了较深的感触,关于美国对于单一颜色商标的注册保护问题便是其中之一。为了更好地对美国颜色商标制度作出介绍,也为了更好地论证该问题,本文大量引用了英美法相关资料,运用英美法的写作方式,以一个真实的著名品牌的单一颜色商标为背景,以笔者半虚构的案例展开讨论,分析胜诉以及败诉的可能性,得出笔者对于单一颜色商标法律应当予以保护,但跨类保护应受到限制的论点。在此基础上,笔者从中国立法及实践环境的角度反思中国对于单一颜色商标的保护的必要性及可能性,进一步结合并参考世界上其他国家的做法,分析比较后给出立法建议,呼吁中国商标法律制度中关于单一颜色商标的有关规定能够继续完善,为能够最大程度地满足当今竞争市场上保护新型商标的需求。
[Abstract]:With the development of commercial activities and the rapid development of media communication and advertising design, the logo that people can recognize as a trademark is not only limited to words or simple graphics, but also can be perceived visually. The logo that distinguishes the goods you operate from those of others has trademark potential. Like many new trademarks, color is becoming an important way for consumers to identify goods. In view of the certain role and importance of color to trademark, this paper specifically discusses the use of color as a form of trademark. And it is the legal protection of single color as trademark. The trademark law system of the world has different regulations on the issue of single color. For example, although the provisions of the trademark law of our country have broken the traditional trademark registration standard, they have already given explicit protection to the color combination trademark. However, the provision on whether a single color can be used as a trademark is still vague. This paper intends to use the first United States law to protect a single color trademark as the main axis. This paper introduces the concept of legislation in the United States to analyze the process and present situation of the legal protection and development of single color trademark, analyzes how the single color trademark is registered and protects in combination with the case, and conceives the possible infringement problems arising from the single color trademark. Combined with the possible legal problems arising from the well-known trademark system, this paper summarizes several legal protection rules after the single color trademark has been registered. During my study in the United States for my master of law in the United States, through case study and the study of statutory laws such as the United States' 1946 Federal Trademark Law, I had a deep feeling for the study of some special issues in trademark law. One of them is the issue of the registration and protection of a single color trademark in the United States. In order to make a better introduction to the color trademark system in the United States and to demonstrate the problem better, this paper uses a large number of Anglo-American law related materials, using the Anglo-American method of writing. Based on the background of a real famous brand single color trademark, this paper discusses the author's semi-fictitious case, analyzes the possibility of winning and losing the lawsuit, and concludes that the author should protect the law of single color trademark. But the argument that cross-class protection should be limited. On this basis, the author reflects on the necessity and possibility of the protection of single color trademark in China from the angle of legislation and practice environment in China, and further combines with the practices of other countries in the world, and gives some legislative suggestions after analysis and comparison. In order to meet the demand of protecting the new trademark in the competitive market, it is called upon that the relevant regulations on the single color trademark in the trademark legal system of China can continue to be perfected to meet the needs of protecting the new type of trademark in the current competitive market.
