古今汉语辞书法律词语释义对比研究

【摘要】：本文通过对古今语文词典和专科词典法律词语释义的系统考察，探讨古今不同类型汉语辞书释义方式、释义内容、释义原则等等，希望进一步丰富汉语辞书释义理论研究的内容，并对语文词典和专科词典编纂或修订工作起到一定的推动作用。释义是词典的生命线。前人对释义的理论和编纂实践进行过大量的研究和探讨，得出了许多丰硕的成果。从文献综述部分可以归纳出，与释义相关的学术成果主要包括训诂与词典释义的关系、语言学与词典学的关系、义素分析法在词义分析中的作用、义项的设立与排列、释义的方式、词典释义的缺陷以及释义元语言等方面的内容。所以第一章绪论部分对近几十年词典释义研究成果进行的整理和归纳，目的是使辞书释义理论体系能够更加完善，使之能够更好地服务于汉语辞书的编纂实践。第二章在分析古代法律词语时，我们将汉语语文词典和法律专科词典共同收录的法律词语的释义作为考察、对比的典型，描写和分析其释义方式的差异情况，总结差异类型并进行量化统计，意在探求造成这些差异的深层原因。随着语言学的发展，特别是词汇语义学研究的精进，与古代辞书法律词语的释义方式相比，现代辞书法律词语的释义方式要复杂得多。第三章运用定量统计与定性分析相结合的研究方法，同样以语文词典和法律专科词典——《现代汉语词典》第5版和《法律辞典》（简明本）为语料选取蓝本，借鉴符淮青先生在《词义的分析和描写》（2006）中所总结的表动作行为的词和表名物的词的释义模式，分别对这两部词典中共同收录的表动作行为的双音节法律词语的释义方式和表名物的双音节法律词语的释义方式进行了详细的考察和对比分析，以求明晰现代辞书法律词语的释义方式的特点，了解法律词语作为普通义位与学科义位在释义方式与词义成分方面的异同。第四章的研究内容就是在前面二、三两个章节的研究成果的基础上，对古今汉语辞书法律词语的释义方式进行纵向的历时比较，展现汉语辞书释义方式在历史发展中取得的进步和存在的问题，，最后对促成古今演变的主要影响因素进行探讨。本研究通过对法律词语释义模式的对比分析发现了一些有价值的规律性现象。同时本文在研究前人释义的基础上，指出了释义中出现的缺点，特别是一些词典编纂者必须面对的、如影随形的缺陷，这也是词典释义能够实现创新的突破点所在。
[Abstract]:Through a systematic investigation of the interpretation of legal words in ancient and modern Chinese dictionaries and specialized dictionaries, this paper discusses the interpretation methods, contents, principles of interpretation of different types of Chinese dictionaries, and so on. The author hopes to enrich the theoretical research on the interpretation of Chinese dictionaries and to promote the compilation or revision of Chinese dictionaries and specialized dictionaries. Interpretation is the lifeline of dictionaries. Many researches and discussions have been carried out on the theory and compilation practice of interpretation, and many fruitful results have been obtained. The academic achievements related to interpretation mainly include the relationship between exegesis and dictionary interpretation, the relationship between linguistics and lexicography, the role of sememe analysis in word meaning analysis, the establishment and arrangement of meanings, and the way of interpretation. The defects of the dictionary interpretation and the contents of the interpretation meta-language. So the first chapter introduces the research achievements of the dictionary interpretation in recent decades, in order to make the theoretical system of lexicographic interpretation more perfect. So that it can better serve the compilation practice of Chinese dictionaries. In the second chapter, when analyzing the ancient legal words, we take the interpretation of the legal words which are included in the Chinese language Dictionary and the specialized Dictionary of Law as an investigation, compare the typical, describe and analyze the differences in the way of interpretation. Summing up the types of differences and quantitative statistics, the purpose is to explore the underlying causes of these differences. With the development of linguistics, especially the study of lexical semantics, compared with the interpretation of legal words in ancient dictionaries, The interpretation of legal words in modern dictionaries is much more complicated. Chapter three uses the research method of combining quantitative statistics and qualitative analysis. The Chinese dictionary and the specialized dictionary of law, the fifth edition of the Modern Chinese Dictionary and the Concise version of the Dictionary of Law, are also used as the source material. Drawing lessons from the interpretation model of the words of action behavior and names summarized by Mr. Fu Huaiqing in "Analysis and description of word meanings" in "the Analysis and description of word meaning" (2006), This paper makes a detailed investigation and comparative analysis of the two dictionaries on the interpretation of the dichotomous legal words of action behavior and of the dicyllabic legal words on the names of the two dictionaries. In order to clarify the characteristics of the interpretation of legal words in modern dictionaries, we can understand the similarities and differences between legal words as common meanings and subject meanings in terms of interpretation methods and semantic components. The research content of Chapter 4th is based on the research results of the preceding two and three chapters, the vertical diachronic comparison of the interpretation of legal words in ancient and modern Chinese dictionaries is carried out. This paper presents the progress and problems in the historical development of the interpretation of Chinese dictionaries, and finally probes into the main influencing factors that contribute to the evolution of the ancient and modern times. Through the comparative analysis of the patterns of interpretation of legal words, this study finds some valuable regular phenomena. At the same time, based on the study of the previous interpretations, this paper points out the shortcomings in the interpretation. In particular, some lexicographers must face the following defects, which is also the breakthrough point that dictionary interpretation can achieve innovation.
