基于阐释循环视角下的法律翻译理解过程

【摘要】：在西方，阐释学原理运用于翻译研究始于19世纪70年代。阐释学原理对于翻译理论以及翻译实践有其指导作用。在法律翻译的理论研究和实践中，，同样可以运用阐释学原理来指导法律翻译。法律语言历来以生涩难懂著称，法律翻译过程中的重要一环乃是对于法律原文本的正确理解。阐释循环理论作为文本解读的一般原则，对文本的理解起到至关重要的作用。之前的研究,主要探索阐释循环性在文学作品中的理解,在教育学中的运用，在艺术作品中的欣赏以及在司法诠释过程中的运用。而将这一原理，恰当地运用于法律文本翻译的理解过程中却凤毛麟角。本文从阐释学的视角，着重论述阐释循环理论在法律翻译过程中，对于原文本理解的运用。阐释循环理论作为文本解读的一般原则要求对文本整体意义的理解，应当建立在构成文本的各细节要素的意义基础之上。而对于构成文本的各细节要素的意义的理解，则应从文本整体所指向的意义出发来完成。离开了任何一个方面，理解都是不准确的。而解释学循环不仅仅只局限在对文本的整体与部分之间的循环。其甚至可以延深贯穿到对文本的字、词和语篇的理解，甚至延伸到对翻译主体，与文本相关的政治、经济、历史、哲学等相关领域上去。本文对阐释循环进行了大致分类，并就不同循环在法律翻译理解过程中的运用再进行分类。作者将与法律相关的阐释循环从宏观角度分为两大类，一类为基础循环；另一类为综合循环。首先，分别从原文本，作者，以及翻译主体三个层次就法律翻译中的基础循环展开论述。总的来说，这一大类循环有利于译者准确地把握法律原文本的法律意蕴，从而正确地指导翻译。其次，对于另一类综合循环的分析，主要通过对翻译主体“偏见”（前理解）的阐释，以及“偏见”融合与情境当中所产生的积极因素和消极因素对法律翻译所产生的影响作用这一角度进行论述。积极的因素是已有的认知就当前法律文本的理解起到指导性的作用，从而使译者正确把握法律文本意蕴。而消极因素，将导致译者对法律文本总体的筹划产生错误的预期。本文将阐释学原理与法律翻译过程中原文本的理解相结合，具有一定的理论创新性。作者希望通过这一研究，可以对法律翻译中的理解过程有更深入的认识，使对法律文本的理解更为准确，也希望将其他阐释学原理运用到法律翻译当中起到一定的启发性作用。
[Abstract]:In the West, the application of hermeneutics to translation studies began in the 1870s. The principle of hermeneutics plays a guiding role in translation theory and practice. In the theoretical research and practice of legal translation, hermeneutics can also be used to guide legal translation. The legal language is always famous for being difficult to understand, and an important part in the process of legal translation is the correct understanding of the original text of law. As a general principle of text interpretation, the interpretation cycle theory plays an important role in the understanding of text. The previous studies mainly explored the understanding of interpretation cycle in literary works, the application in pedagogy, the appreciation of works of art and the application of judicial interpretation. However, the application of this principle to the understanding of legal text translation is rare. From the perspective of hermeneutics, this paper focuses on the application of hermeneutical cycle theory in the process of legal translation. As a general principle of text interpretation, the interpretation cycle theory requires the understanding of the text's overall meaning, which should be based on the meaning of the detailed elements that make up the text. The understanding of the meaning of each detail element of the text should be completed from the meaning of the text as a whole. Without any aspect, understanding is inaccurate. The hermeneutics cycle is not only confined to the whole and part of the text. It can even extend to the understanding of words, words and discourses in the text, and even to the subject of translation, the political, economic, historical, philosophical and other related fields related to the text. In this paper, the interpretation cycle is roughly classified, and the application of different cycles in the process of legal translation comprehension is reclassified. The author divides the interpretation cycle related to law into two categories from the macro point of view: one is the basic cycle and the other is the comprehensive cycle. Firstly, the basic cycle of legal translation is discussed from three levels: the original text, the author and the subject of translation. Generally speaking, this kind of circulation is helpful for the translator to grasp the legal meaning of the original legal text accurately and guide the translation correctly. Secondly, the analysis of another kind of comprehensive cycle is mainly based on the interpretation of the "prejudice" (pre-understanding) of the subject of translation. From the perspective of the positive and negative factors in the fusion of prejudice and the situation, this paper discusses the influence of the negative factors on the legal translation. The positive factor is that the existing cognition plays a guiding role in the understanding of the current legal text so that the translator can correctly grasp the meaning of the legal text. Negative factors, however, will lead to the translator's wrong expectation on the overall planning of legal texts. This paper combines the principle of hermeneutics with the understanding of the original text in the process of legal translation. Through this study, the author hopes to have a deeper understanding of the understanding process in legal translation, to make the understanding of legal texts more accurate, and to apply other hermeneutical principles to legal translation to a certain extent.
