律师代理词中介入资源的顺应性分析

【摘要】：本文将评价理论和顺应论有机结合,建立了一个介入资源顺应分析模式,用来分析律师代理词中介入资源的使用规律并解释律师如何动态地选择介入资源以顺应语境,最终实现交际目的。研究发现,代理词中使用较多的介入资源有否定、反驳、背书、接纳、承认等资源。而这些介入资源是律师为了顺应法官和听众的接受心理、律师自己的心理动机、法庭言语规范、庭审各方权力关系而做出的语言选择。其中,反驳、接纳、背书、承认多是对心理世界的顺应,否定、接纳、背书多是对社交世界的顺应。但在交际中,律师不会只考虑顺应一种因素,而往往是三种因素共同起作用。此外,在交际中,律师所选择的语言顺应并不是固定不变的,而是随着交际的进展、事态的发展以及交际双方关系的变化随时做出动态的调整。
[Abstract]:This paper combines the theory of evaluation with the theory of adaptation, and sets up a model of adaptation analysis of intervention resources, which is used to analyze the rules of use of intervention resources in lawyers' representation words and to explain how lawyers dynamically choose intervention resources to adapt to the context. Finally, the purpose of communication is achieved. It is found that more intervention resources are negation, rebuttal, endorsement, acceptance, admission and so on. These intervention resources are language choices made by lawyers in order to conform to the acceptance psychology of judges and listeners, lawyers' own psychological motives, court language norms, and power relations between parties in court hearings. Among them, rebuttal, acceptance, endorsement, admission are the adaptation to the psychological world, negation, acceptance and endorsement are mostly the adaptation to the social world. However, in communication, lawyers do not only consider one factor, but often three factors work together. In addition, in communication, the language adaptation chosen by lawyers is not fixed, but with the progress of communication, the development of the situation and the change of the relationship between the two parties to the communication make dynamic adjustment at any time.
