晚清西方法律的引进及翻译

【摘要】：在中国翻译历史上,清代是一个特殊的历史时期。晚清以降,由于西方列强的入侵,西方各种先进文化亦涌向国内,其中包括发展较为系统的西方法学文化。清朝官方法律翻译可以追溯至清军入关后民族语言尤其是满汉语言间的法律语言翻译,而清代官方组织介绍引进西方法律的历史,以“开眼看世界第一人”林则徐为开端。本文根据历史事件,将晚清分成四个重要的阶段,分别分析不同阶段的法律引进以及法律翻译,较为系统地考察了晚清时期西方法律以及法学著作引进及其翻译的具体情况,并从中归纳出晚清法律翻译采取的翻译策略以及译名混乱的问题。晚清西方法律的引进和翻译取得的重大成就,对当时以及当今的法律语言文化引进和翻译具有重要的参考意义。从晚清到如今,“中国的法律语言是一个充满了外来语的世界。”本文旨在通过对晚清法律翻译进行深入的研究,着重分析其发展历程、翻译策略以及存在的问题等,以期对今后法律语言翻译及其研究有所裨益。
[Abstract]:In the history of Chinese translation, the Qing Dynasty is a special historical period. Due to the invasion of western powers, various advanced cultures of the West also poured into China, including the development of a more systematic western legal culture. The official legal translation of the Qing Dynasty can be traced back to the translation of the national languages, especially the legal languages between the Manchu and the Chinese languages after the entry of the Qing Dynasty. The official organizations of the Qing Dynasty introduced the history of the introduction of western law, starting with "the first Man in the World" Lin Zexu. According to the historical events, this paper divides the late Qing Dynasty into four important stages, analyzes the legal introduction and legal translation in different stages, and systematically examines the specific situation of the introduction and translation of western law and legal works in the late Qing Dynasty. The translation strategies adopted in legal translation in the late Qing Dynasty and the confusion in the translation of names are also summed up. The great achievements in the introduction and translation of western laws in the late Qing Dynasty are of great significance to the introduction and translation of legal language and culture at that time and today. From the late Qing Dynasty to the present, "China's legal language is a world full of foreign words." The purpose of this paper is to make an in-depth study of legal translation in the late Qing Dynasty, focusing on its development, translation strategies and existing problems, in order to be of benefit to the future legal language translation and its research.
