论功能翻译理论在法律翻译中的适用性

　　自人类社会产生,法律和语言可以堪称最伟大的两项发明。语言是人类思想交流最重要的载体,而法律作为最高行为准则维系社会的运转、更替、发展。语言与法律是紧密联系在一起的。中国法律有着悠久而辉煌的历史,相传早在公元前2000年前的夏朝就已经有了比较完备的刑律。然而在西方,一直到公元前5世纪的希腊才形成了法律体系。关于法律的起源,中国比西方要早得多。但遗憾的是中国对法律翻译的研究起步却很晚。旧中国闭关锁国的政策严重阻碍了我国法律翻译的进程及其对法律翻译的研究。新中国成立以后,法律翻译及其对其研究逐渐受到重视。随着我国加入世界贸易组织及其全球化进程的加快,我们应当更加关注法律翻译在社会生活中所起的重要作用。尤其是近年来,2008奥运会,全球经济危机以及2010世博会使世界成为一个整体,同时也使人们深刻感受到世界的紧密联系。毫无疑问,法律翻译在人类文明进程中起了重要作用。正如Susan Sarcevic所说,我们正处在一个多语时代,而翻译成了各国关系及法律沟通的媒介。翻译文本同样具有法律效力,甚至会带来和平或者引起战争。如今随着人员、物资和资本自由流通需求的增加,法律翻译对社会生活的各个方面都产生了...
