功能翻译理论视角下商务合同翻译研究

【摘要】：随着经济的发展和全球化,商务合同不仅在促进跨国经济交易和规范市场秩序方面起着非常重要的作用,而且也成为中外当事人开展业务和维护权益的一种重要法律依据。由于合同对各方权利义务的规定不够明确,或因合同措辞不当、词义含混不清、文义松散宽泛等原因,使合同一方有意或无意地利用合同漏洞以逃避责任和义务,结果导致合同纠纷,甚至商业敲诈。因此,商务合同翻译的好坏在国际贸易活动中发挥着越来越重要的作用。如何做好商务合同翻译,就越显得极为重要。 目前,国内对商务合同翻译的研究主要是从文体学、语域学或功能语法学的角度进行分析,仍然存在大量的不准确、机械的翻译现象,所以还需要理论指导。在当代西方翻译理论中,德国功能翻译理论为指导翻译实践提供了一个全新的视角。该理论产生于20世纪70年代,已发展成为一个相当成熟的理论体系,以奈达和纽马克为代表的功能对等论,以汉斯·弗米尔为代表的功能学派提出的目的论、连贯性法则,“功能加忠诚”原则,在翻译研究中影响深远。然而,国内学者对功能翻译理论的研究,主要集中在文学翻译领域如诗歌翻译等,对合同翻译的研究较少。用功能翻译理论研究商务合同翻译,是从一个新的视角对商务合同翻译进行研究。 如何用功能翻译理论指导商务合同翻译?首先,本论文对商务合同翻译研究现状进行了文献综述。其次,对功能翻译理论进行了介绍,引入了像“文本分析理论”、“翻译目的论”、“翻译纲要”、“功能和忠诚原则”等概念。第三,笔者从宏观层面如商务合同文本类型、文本目的、原文本分析等方面对商务合同进行了分析,并辅之以实例加以论证。同时,也从微观层面如词汇、句子及篇章等方面对商务合同语言特点进行了分析和总结,从而论证了功能翻译理论对商务合同翻译的适用性。此外,笔者还指出了商务合同翻译中存在的一些问题如金额翻译、专业词汇翻译等,并辅之以翻译实践实例进行分析。最后,笔者对全文进行了总结,并提出了不足之处以及进一步研究的建议。 通过进行该论文的写作,笔者对商务合同的语言特点以及功能翻译理论的使用更为娴熟,并在翻译实践中尽量避免一些机械、不准确的翻译,同时为那些从事商务合同翻译的译者们能够提供借鉴,使其担负起译者的责任,把合同翻译工作做得更好。
