关联理论视角下法律术语的翻译研究

　　在斯柏伯和威尔逊的关联理论的基础框架内,格特将关联理论应用于翻译研究中,探讨了翻译研究中颇具争议又引人注目的重要问题。本文就试图用关联翻译理论来描述翻译过程中译者对法律术语的处理,以来解释法律术语翻译不一致的现象。根据格特运用关联理论分析翻译过程取得的成果,法律术语翻译是一个双明示推理的动态过程,译者的翻译过程就是寻找最佳关联的过程。译者在法律术语刺激下,其大脑中的各种认知语境也被调动起来,完成推理一明示的过程,选择目的语完成翻译。最佳关联点不同,明示给受众的结果就存在不同。在翻译过程中,不确定的因素导致了术语不同翻译的产生。本文概述了目前法律术语翻译采取的不同策略,分析了法律术语翻译的一些知名学者的风格与特色,阐述了关联理论的研究内涵及其与法律术语翻译研究的关系,回答了同一法律术语为什么会有不同译文这一问题：法律术语多义性是产生不同翻译一个因素；不同的法律文化也是造成法律术语翻译不一致性的另一原因；译者的法律知识、译者的双语能力也影响着最终的翻译结果；译者对受众的认知语境评估也影响着最终的译文产出。本文列举了合同法的两种不同译文,并运用分析得出的语境、法律文化、语言能力、法律知识、法...
