中国刑事审判中冲突性话语结构模式与成因研究

　　法庭话语研究作为跨学科研究,近年来始终备受关注。作为冲突性话语的典型代表,庭审话语时时刻刻充斥着参与者之间不同程度的较量。然而,迄今为止,对于庭审互动冲突性话语结构模式的相关研究却寥寥无几。因此,本文以合作连续体为基础,构建冲突连续体,并以三话步结构为描述框架,目的原则为解释框架,试图回答以下问题:1)中国刑事审判互动中的冲突性话语的结构模式是怎样的?2)各方参与者之间的冲突程度如何?3)如何解释其结构模式和冲突程度的成因?对前两个问题的回答需要对法庭话语中的冲突话语进行充分描述,而最后一个问题则需要对冲突话语进行详尽解释。为了探究上述问题,我们收集真实庭审语料,采用定性分析法,重点探究了法官与被告方、公诉方与被告方之间的冲突性话语。研究发现,在结构模式上,刑事审判中法官与被告方、公诉方与被告方之间的冲突性话语启始话步的主要结构模式为提问——陈述和陈述——反对/打断两种;冲突话步主要包含否认回避型、提醒注意/重申规定型、单方驳斥型、一方责备型和对抗争论型五种;结束话步主要包含搁置/忽视、第三方介入、强制退让式、非顺从式屈服以及顺从五种。就冲突程度而言,我们基于构建的冲突连续体研究发现,...
