【摘要】：黑格尔把婚姻规定为"具有法的意义的伦理性的爱"。在这一规定中,伦理关系的本质是实体性的关系,"爱"的本质是意识到自我和他人的统一。黑格尔认为,婚姻的实质是伦理关系,而非两性的自然关系,也非现代人理解的民事契约关系。他把婚姻视为家庭的概念在其直接阶段的表现形态,同时又把家庭看作自然和直接的伦理实体。家庭成为伦理的直接策源地,逻辑地导出婚姻不仅是伦理的而且必须是伦理的。现代性以理性和主体性为两大原色,形成了现代社会中理性主义和个人主义的两大倾向;这两大倾向形成了理性与精神、个体与伦理对峙的局面,造成了以理性僭越精神、以原子式的个人僭越伦理整体性的现代性后果。这一现代性后果在当前婚姻中的真实镜像,便是现实社会中反映出来的部分人谈婚色变、婚不起、婚无能等问题。婚姻能力的退化表征着现代人伦理能力的退化,而伦理能力的退化则可能导致人类对于价值和意义世界的莫衷一是。面对这种局面,我们亟需对现代性婚姻进行伦理精神的"复魅",对婚姻的伦理性进行学术肯认成为这项工作的关键一环,黑格尔在法哲学中对婚姻的伦理阐释成为我们最直接的学术资源。
[Abstract]:Hegel defined marriage as "ethical love with the meaning of law". In this provision, the essence of ethical relationship is substantive relationship. The essence of "love" is to realize the unity of self and others. Hegel believes that the essence of marriage is an ethical relationship, not a natural relationship between the sexes. He regards marriage as the manifestation of the concept of family in its direct stage, and at the same time regards the family as the natural and direct ethical entity, and the family as the direct source of ethics. The logical derivation of marriage is not only ethical but also ethical. Modernity takes rationality and subjectivity as its primary colors and forms two major tendencies of rationalism and individualism in modern society. These two tendencies formed the situation of rationality and spirit, and the confrontation between individual and ethics, which resulted in the surpassing of spirit by reason. The real mirror image of the modernity consequence in the current marriage is the part of people who talk about marriage change and can't afford it. The degradation of marital ability represents the degradation of ethical ability of modern people, and the degradation of ethical ability may lead to different opinions about the world of value and meaning. It is urgent for us to reinvigorate the ethical spirit of modern marriage, and the academic acceptance of the ethical nature of marriage becomes the key link of this work. Hegel's ethical interpretation of marriage in legal philosophy has become our most direct academic resource.
