论康德对“出自人类之爱而说谎的权利”的批评

【摘要】：康德在《论出自人类之爱而说谎的所谓权利》一文中认为,说真话是一种形式义务,人们应该无条件地履行这个义务,不管由此导致什么后果。贡斯当和科尔斯戈德分别从法学层面和伦理学层面对这个观点进行批评,都认为康德所谓的不说谎义务在现实中缺少可行的条件,不可能得到普遍遵守,但是这并不能从理论上反驳康德的"应当不说谎"观点。康德的绝对不说谎义务的理论困难主要在于,未能真正直面不同道德义务之间的冲突,未能指出解决不同道德义务冲突的依据。
[Abstract]:In the so-called right to lie out of human love Kant argues that telling the truth is a formal obligation that one should fulfil unconditionally no matter what the consequences. Gunstein and Colesgott criticized this view from the legal level and the ethical level, respectively, and both thought that Kant's so-called obligation not to lie lacked feasible conditions in reality and could not be universally adhered to. But this does not theoretically refute Kant's view that lies should not be told. The theoretical difficulty of Kant's obligation not to lie mainly lies in his failure to face up to the conflict between different moral obligations and to point out the basis for resolving the conflict between different moral obligations.
