中俄教育督导法律制度比较研究

【摘要】:教育督导制度历史悠久,它既是一项行政监督制度,也是一项教育法律制度。1995年颁布的《中华人民共和国教育法》第24条明确规定:国家实行教育督导制度和学校及其他教育机构教育评估制度。《职业教育法》第11条,《高等教育法》第44条,《民办教育促进法》第40条和《义务教育法》第8条都对教育督导制度作了明确的法律规定。但一直以来,教育督导法制建设并未得到应有的重视。2012年10月《教育督导条例》的颁布,标志着教育督导法制进入到一个新的发展时期。本论文正是在此背景下选取这一较新的研究方向,以期为我国教育督导法律制度的发展和完善提出自己的建议。 笔者之所以选取俄罗斯的教育督导法律制度进行比较,原因基于以下几点:第一,俄罗斯作为世界知名的教育大国,其教育督导制度起源较早,有150多年的历史。俄罗斯拥有一套完整、系统且独立的教育督导制度,以科学的评价手段、合理的评价指标体系和完善的法律法规为依据,充分发挥教育督导的职能,其先进的制度和经验值得我国借鉴。第二,俄罗斯与中国在教育领域有着深厚渊源。通过比较,也可以发现两国教育督导法律制度各有优劣。本文通过中俄两国教育督导法律制度的对比,以期为我国的教育督导法律制度提供有益的借鉴。 全文分为六个部分:第一部分是绪论。在这部分包括选题缘由、相关概念、文献综述等。第二部分是中俄两国教育督导法律制度的历史演变,分时期、分阶段梳理了中俄教育督导法制的历史进程。第三部分比较了中俄两国的教育督导法律构建,主要从立法背景和法律体系两个方面对中俄两国的教育督导法律作了比较。第四部分是中俄教育督导机构法律制度的比较,从机构设置、机构独立性、机构职权、机构人员和机构合作机制五个方面进行比较,分析各自的特点。第五部分是中俄教育督导职能、方式法律制度的比较。第六部分是结语。 通过比较中俄两国的教育督导法律制度,笔者发现两国在教育督导法律制度层面是存在某些相似之处的,但由于历史背景,社会发展阶段等方面的原因,在具体法律制度方面又存在较大差异。笔者希望通过科学的分析和比较,对两国教育督导制度进行客观评价,更重要的是以期为我国教育督导法律制度的构建和完善贡献自己的一份微力。
[Abstract]:Education supervision system has a long history, it is an administrative supervision system. Article 24 of the Education Law of the people's Republic of China, promulgated on 1995, clearly states that:. The State implements a system of educational supervision and evaluation of education in schools and other educational institutions. Article 11 of the Vocational Education Act. Article 44 of the Law on higher Education, Article 40 of the Law on the Promotion of Private Education and Article 8 of the Law on compulsory Education provide clear legal provisions on the system of educational supervision. The construction of educational supervision legal system has not been given due attention. In October 2012, the Regulation of Educational Supervision was promulgated. This paper chooses this relatively new research direction precisely under this background, marks the educational supervision legal system to enter a new development period. In order to develop and perfect the legal system of educational supervision in our country, the author puts forward his own suggestions. The author chooses the Russian educational supervision legal system to carry on the comparison, the reason is based on the following several points: first, Russia as the world famous education big country, its educational supervision system origin is early. Russia has a complete, systematic and independent educational supervision system, based on scientific evaluation means, reasonable evaluation index system and perfect laws and regulations. Give full play to the function of educational supervision, its advanced system and experience is worth learning. Second, Russia and China in the field of education have a deep origin. Through comparison. We can also find that the legal system of educational supervision in both countries has its own merits and demerits. Through the comparison of the legal systems of educational supervision between China and Russia, this paper hopes to provide a useful reference for the legal system of educational supervision in our country. The full text is divided into six parts: the first part is the introduction. In this part, including the reason of the topic, related concepts, literature review, etc. The second part is the historical evolution of the legal system of educational supervision in China and Russia, divided into periods. The third part compares the legal construction of educational supervision between China and Russia. Mainly from the legislative background and the legal system of the two countries to make a comparison of the law of educational supervision. 4th part is the comparison of the legal system of educational supervision institutions in China and Russia, from the establishment of institutions, institutional independence. This paper compares the functions and powers of institutions, personnel and cooperative mechanisms of institutions, and analyzes their respective characteristics. Part 5th is a comparison of the functions of educational supervision in China and Russia, and the comparison of the ways and legal systems. Part 6th is the conclusion. By comparing the legal system of educational supervision between China and Russia, the author finds that there are some similarities in the legal system of educational supervision between the two countries, but due to the historical background, social development stage and other reasons. There are great differences in the specific legal system. The author hopes to make an objective evaluation of the educational supervision system of the two countries through scientific analysis and comparison. More importantly, it is expected to contribute to the construction and perfection of the legal system of educational supervision in our country.
