社科法学的研究格局:从分立走向整合

【摘要】：社科法学并非只是强调"跨"学科,而是注重整合法学与其他学科,研究与法律相关的经验事实。从研究进路来看,国内社科法学已经形成规模的是法律社会学、法律经济学和法律认知科学。这三种进路存在一定的知识递进关系。从观察视角来看,社科法学可以从宏观社会、微观社会和微观个体的视角展开研究。而且随着实地调查的变化,研究者也需要经常进行视角的转换。从认识论来看,社科法学主张批判主客二分、法律/社会的二元对立观念,强调研究"视域融合",即有关法律经验事实的知识要通过研究者、他者和共同面对的世界这样一种三角关系获得。从研究方法来看,社科法学倾向于实现定性方法与定量方法、经验事实与理论抽象、经验研究与规范分析的有机整合。
[Abstract]:Social science law is not only to emphasize the "cross" discipline, but to focus on the integration of law and other disciplines, and to study the empirical facts related to law. The domestic social science law has formed the scale is the legal sociology, the law economics and the law cognition science. These three kinds of approaches have certain knowledge progressive relations. From the observation angle, the social science law can be viewed from the macroscopic society. With the change of field investigation, researchers also need to change the perspective. From the perspective of epistemology, social science law advocates the dichotomy of criticism between subject and object. The dualistic concept of law / society emphasizes the study of "horizon fusion", that is, the knowledge of the facts of legal experience should be passed through the researcher. From the perspective of research methods, social science law tends to achieve qualitative and quantitative methods, empirical facts and theoretical abstraction. The organic integration of empirical research and normative analysis.
