英国中小学教师惩戒权研究及启示

【摘要】:教育作为一种专门培养人的特殊活动,是由专职人员和专门机构承担的有目的、有计划、有组织的,以影响入学者的身心发展为直接目标的活动。在该活动中,教师拥有对学生的教育权,其中当然也包括对学生违规行为的惩戒权。处于中小学教育中的未成年学生无法排除外来的各种影响,因此在其走向自律之前,他律常常是必经的途径之一。在此过程中,教师惩戒权的合理合法实施便显得尤为重要。 教师惩戒权的合理合法实施与不仅与中小学校的良好学习环境息息相关,而且更关系到广大中小学生的健康发展,正是基于此点,本文在对中小学教师惩戒权的理论依据及英国中小学教师惩戒权作了简述之后,重点分析了英国中小学教师惩戒权的具体实施及其对我国的启示。本文主体结构分为四个部分:第一,对中小学教师惩戒权的理论依据作了简要介绍,主要介绍了中小学教师惩戒权的心理学、教育学及法律依据;第二,对英国中小学教师惩戒权进行了阐述,首先叙述了英国中小学的纪律状况在实施新增教师惩戒权前后的转变;其次,阐述了英国中小学教师惩戒权的历史发展;第三,重点阐述了英国中小学教师惩戒权的实施情况,首先阐释了英国法律赋予教师的惩戒权细则;其次,分析了英国教师惩戒权的指导大纲;最后,通过两个相关的真实案例来描述英国教师惩戒权的具体实施。第四,在对英国中小学教师惩戒权分析的基础上总结出英国中小学教师惩戒权对我国的启示,首先,分析了我国中小学教师惩戒权行使中存在的问题及其原因;其次,阐述制定教师惩戒权的必要性;然后,分析教师惩戒权实施的原则;最后,阐述了保护教师惩戒权顺利实施的必要措施。
[Abstract]:Education, as a special activity devoted to the cultivation of human beings, is a purposeful, planned and organized activity undertaken by full-time personnel and specialized institutions with the direct aim of affecting the physical and mental development of the scholars. In this activity, Teachers have the right to education for students, including, of course, the right to punish students for violating the law. Minor students in primary and secondary education cannot exclude all kinds of foreign influences, so before they move towards self-discipline, Heteronomy is often one of the necessary ways. In this process, the rational and lawful implementation of teachers' disciplinary power is particularly important. The rational and lawful implementation of teachers' right to discipline is closely related not only to the good learning environment of primary and secondary schools, but also to the healthy development of the majority of primary and middle school students. This paper gives a brief account of the theoretical basis of the disciplinary power of primary and secondary school teachers and the disciplinary power of British primary and secondary school teachers. The main structure of this paper is divided into four parts: first, the theoretical basis of the disciplinary power of primary and secondary school teachers is briefly introduced. It mainly introduces the psychology, pedagogy and legal basis of the disciplinary power of primary and secondary school teachers. Secondly, it expounds the disciplinary power of British primary and secondary school teachers. First, it describes the change of the disciplinary status of the British primary and secondary schools before and after the implementation of the newly added disciplinary power; secondly, it expounds the historical development of the disciplinary power of the British primary and secondary school teachers; thirdly, it focuses on the implementation of the disciplinary power of the British primary and secondary school teachers. First of all, it explains the rules of disciplinary power granted to teachers by British law; secondly, it analyzes the guiding outline of the disciplinary power of teachers in Britain; finally, it describes the concrete implementation of the disciplinary power of teachers in the United Kingdom through two relevant real cases. 4th, On the basis of the analysis of the disciplinary power of British primary and secondary school teachers, this paper summarizes the enlightenment of the right to discipline of British primary and secondary school teachers. Firstly, it analyzes the problems existing in the exercise of the disciplinary power of primary and secondary school teachers in our country and the reasons for it. This paper expounds the necessity of establishing teachers' disciplinary power; then, analyzes the principles of teachers' disciplinary power implementation; finally, expounds the necessary measures to protect teachers' disciplinary power.
