旧城改造中的利益博弈与政府法治——以渭南市临渭区旧城改造为例

【摘要】：通过对临渭区旧城改造的调研,发现存在政府、开发商及被拆迁户的利益博弈、依法行政、群众利益诉求的扭曲及法治政府的权力架构等问题,而这些问题的核心是利益协调与政府法治。在研究政府角色定位、旧城改造中的公共利益、正当程序以及调控工具等旧城改造的顶层设计的基础上,提出协调各方利益与政府法治这一核心问题的四个解决策略。
[Abstract]:Through the investigation of the old city reconstruction in Linwei District, it is found that there are some problems such as the government, the developers and the residents who have been demolished, the game of interests, the administration according to law, the distortion of the interests of the masses and the power structure of the government ruled by law, etc. The core of these problems is the coordination of interests and the rule of law. On the basis of the study of the role of government, the public interest in the transformation of the old city, due process and regulatory tools, and other top-level design of the old city, This paper puts forward four solutions to the core problem of coordinating the interests of all parties with the rule of law by the government.
