重要立法事项第三方评估机制研究

【摘要】：为解决由于部门利益之争而导致的立法久拖不决现象,有必要对重要立法事项引入第三方评估制度。第三方评估的主体应当由具有专业性、中立性、公信力的机构担任,可以建立第三方评估机构信息库。当出现重要立法事项且因部门利益而产生争议时,立法决策机关或争议双方可委托第三方评估机构对之进行评估。第三方评估机构按照一定的评估程序,在与各方协商的基础上作出公正的评估报告。评估报告应转化为立法决策机关的决定,作为立法决策的重要依据。
[Abstract]:In order to solve the problem of legislation procrastination, it is necessary to introduce the third-party evaluation system into important legislative matters. The main body of third-party evaluation should be specialized, neutral and credible organizations. A third party evaluation agency information base may be established. When important legislative matters arise and disputes arise over sectoral interests, The legislative decision-making organ or the disputing parties may entrust a third-party evaluation agency to evaluate it. The third-party evaluation body shall follow certain evaluation procedures, An impartial evaluation report should be made on the basis of consultation with the parties. The evaluation report should be translated into the decision of the legislative decision-making organ as an important basis for legislative decision making.
