法学学者的知识权力问题研究

【摘要】：法学学者拥有法知识权力。法学学者以教学和科研为主要职业模式,应专业、中立、理性地参与法治建设协作,警惕因个体的局限性影响法知识的支配力。法知识有弱真伪性、实践性、立场性,其转化应遵循知识权力的支配路径。权威是法知识产生支配力的内因,但权威的专断等或影响知识权力的正当性。法知识权力运行应突出法学学者的品格与能力,学者应通过整合共识,提供理论与方法,贡献批判与揭示,实现知识权力的法治建设功用最大化。
[Abstract]:Legal scholars have the power of legal knowledge. Law scholars should take teaching and scientific research as the main professional model, should participate in the construction of the rule of law in a professional, neutral and rational way, and be alert to the influence of individual limitations on the dominance of legal knowledge. Legal knowledge has weak authenticity, practicality and stand, and its transformation should follow the dominating path of knowledge power. Authority is the internal cause of the dominating power of legal knowledge, but the arbitrariness of authority influences the legitimacy of intellectual power. The operation of legal knowledge power should emphasize the character and ability of legal scholars. Scholars should integrate common understanding, provide theory and method, contribute to criticism and revelation, and realize the maximization of the function of rule of law construction of knowledge power.
