《谢尔曼法》诞生的历史考察

【摘要】：美国是世界上最早进行反垄断立法的国家,其反垄断法历史悠久、体系完整、影响力巨大。1890年颁布的《谢尔曼反托拉斯法》奠定了美国反托拉斯法的基础,也是世界上第一部现代意义的反垄断法,为后世各国的反垄断立法树立了典范。《谢尔曼法》的诞生有其深刻的历史根源。这些历史因素主要集中产生于美国独立战争结束后近30年的工业革命时期。工业化导致的经济结构巨变和经济集中是《谢尔曼法》诞生的经济基础；主要由中小企业、农场主和工人等阶层发起的反垄断运动是《谢尔曼法》诞生的社会基础；美国自由民主的思想传统是《谢尔曼法》诞生的思想基础。本文在借鉴国内外研究成果的基础上,尝试从上述三个方面对《谢尔曼法》诞生的根源,从整体上进行深入的历史考察,以期对现阶段我国竞争法制体系的构建与完善有进一步的认识。
[Abstract]:The United States is the first country in the world to legislate on antitrust, its antitrust law has a long history, complete system and great influence. The Sherman Antitrust Law promulgated in 1890 laid the foundation of American antitrust law. It is the first anti-monopoly law in the world, which sets a model for the antitrust legislation of later countries. The birth of Sherman Law has its profound historical roots. These historical factors mainly originated from the Industrial Revolution nearly 30 years after the end of the American Revolutionary War. The economic structure and economic concentration caused by industrialization are the economic foundation of the birth of Sherman Law, and the anti-monopoly movement initiated mainly by the middle and small enterprises, farmers and workers is the social foundation of the birth of Sherman Law. The ideological tradition of American liberal democracy is the ideological foundation of the birth of Sherman Act. Based on the domestic and foreign research results, this paper attempts to explore the origin of Sherman Law from the above three aspects, and make a thorough historical investigation on the whole. The author hopes to have a further understanding of the construction and perfection of China's competition legal system at this stage.
