选择与权利界定的问题——重新理解“科斯定理”

【摘要】：科斯定理是关于权利界定的,然而定理中的"选择"在很大程度上被科斯继承者所忽视。科斯定理能够提出主要因为"损害具有相互性"这个新的分析角度,但相互性的本质是稀缺资源配置问题,将权利冲突等价于相互性并以此分析权利配置,只会消解权利的多重属性。科斯为权利界定的难题提供了一个有用的分析思路,但仅以财富最大化为准据太冷酷、更非充分。法律人要想正确理解科斯,必须重视"企业的性质"所提出的方法。
[Abstract]:Coase Theorem is about the definition of right, but the choice in the theorem is largely ignored by the successor of Coase. Coase Theorem is able to put forward a new analytical angle mainly because of the reciprocity of damage, but the essence of reciprocity is the problem of allocation of scarce resources, which equates the conflict of rights with reciprocity and analyzes the allocation of rights. It will only dispel the multiple attributes of power. Coase provides a useful analytical approach to the problem of defining rights, but it is too cold, much less sufficient, to maximize wealth. In order to understand Coase correctly, the legal person must attach importance to the method of "the Nature of Enterprise".
