法治自信时代的法律文化输出论略

【摘要】：在世界经济、政治和文化的结构变迁中,中国正迎来自信时代。道路自信、理论自信、制度自信促使"法治中国"建设形成独特的法律思想和法治路向。中国特色社会主义法律文化逐步形成并随着"中国模式"向外输出,逐步在世界法律文明体系中居于重要地位。在现代性境遇、全球化进程和信息化时代的现实交错中,巩固民族国家主体地位、掌握国家话语权、把握法律革命先机使法律文化输出成为自信中国必然的时代使命。作为后发型法治国家,自信的中国已经在发展中积聚了经济动力、政治推力和社会合力,法律文化输出得以可能。异质性的中国法律文化要为世界其他民族国家和人民所认同和内化,必须具备综合性输出能力、回链型输出机制和多元化输出策略才能有所作为。而法学研究则需要在自信中国法律文化输出的理论与实践中适时转向,建构起中国化的主体性法理研究路径。
[Abstract]:Amid structural changes in the world economy, politics and culture, China is ushering in an era of confidence. Road confidence, theory confidence and system confidence promote the construction of "China ruled by law" to form a unique legal thought and direction of the rule of law. The legal culture of socialism with Chinese characteristics has gradually formed and exported to the outside with the "Chinese model", and gradually occupies an important position in the legal civilization system of the world. In the context of modernity, globalization and the reality of the information age, consolidating the status of the national state as the main body, mastering the right of the state to speak, and grasping the first opportunity of the legal revolution make the export of legal culture become an inevitable mission of confident China. As a country ruled by law, a confident China has accumulated economic power, political thrust and social cooperation in its development, and the export of legal culture is possible. If the heterogeneous Chinese legal culture is to be recognized and internalized by other nations and peoples in the world, it must have the ability of comprehensive export, the output mechanism of return chain and the strategy of diversified output. However, legal research needs to turn in the theory and practice of confident Chinese legal culture export, and construct the research path of subjectivity jurisprudence in China.
