论民间规范与地方立法的良性互动

【摘要】：目前,学术界对民间规范与地方立法间互动问题关注较少。实际上,适用的地域性和内容的民间性使得民间规范与地方立法具有天然联系,为两者良性互动提供了前提条件。大多数民间规范的内容只有通过地方立法才能获得合法性,并使之明确化、规范化;地方立法只有不断从民间规范中汲取养分,才能不断充实内容,获得社会民众的认同。要建立以地方立法为中心对民间规范进行吸纳、引导和规制的互动机制,地方立法不仅要吸收民间规范的有益成分,还要对民间规范进行引导、规制甚至治理,以防止有些不符合社会发展趋势的民间规范抵消了地方法治的效果。为此,必须对地方立法权限进行适当扩大,以实现地方立法对民间规范的吸纳和规制功能。
[Abstract]:At present, the academic circles pay little attention to the interaction between folk norms and local legislation. In fact, the regional nature and the folk nature of the content make the folk norms and local legislation have a natural link, which provides a prerequisite for the benign interaction between the two. The content of most folk norms can obtain legitimacy only through local legislation, and make it clear and standardized. Only if local legislation continuously draws nutrients from folk norms, can the content be enriched and recognized by the public. In order to establish an interactive mechanism to absorb, guide and regulate folk norms with local legislation as the center, local legislation should not only absorb the beneficial elements of folk norms, but also guide, regulate and even govern folk norms. The local rule of law is counteracted by folk norms that do not conform to social trends. Therefore, it is necessary to expand the local legislative authority properly in order to realize the absorption and regulation function of local legislation to folk norms.
