美国法学院的法律职业道德教育模式研究

【摘要】：法律职业道德是律师能够成为社会正义的看门人和职业道德领导者的关键和保证,而法学院的法律职业道德教育是法律职业道德形成的重要环节。现行中国法学院的法律职业道德教育采取的仍然是传统课堂讲授的教育方法,无法有效地提高学生解决职业道德问题的能力。美国法学院在法律职业道德教育中充分运用认知科学和道德心理学的相关理论,采取辅助性讨论、法律门诊、多学科渗透和团队协作等教育策略,有效地促进了学生职业道德的内化,值得借鉴。
[Abstract]:Legal professional ethics is the key and guarantee for lawyers to become the gatekeepers and professional moral leaders of social justice, and the legal professional ethics education in law schools is an important link in the formation of legal professional ethics. The current law professional ethics education in Chinese law schools still adopts the traditional teaching method, which can not effectively improve the students' ability to solve professional ethics problems. American law schools make full use of the relevant theories of cognitive science and moral psychology in the education of legal professional ethics, and adopt educational strategies such as auxiliary discussion, legal outpatient service, multi-disciplinary infiltration and teamwork, etc. It has effectively promoted the internalization of students' professional ethics, which is worthy of reference.
