美国解决现当代海洋争端的方式及其启示

【摘要】：美国在20世纪面临众多海洋争端,所涉及的地理范围也相当广泛。这其中既包括传统的领土争端,也包括伴随着国际海洋法的变迁和全球海域的重新划分而出现的新型海洋争端。美国在处理这些海洋争端时展现出十分清晰的海洋战略远见,对于战略位置至关重要的岛礁和海域,美国牢牢掌握在手中。而在其他相对次要的海洋争端问题上,美国根据争议对象的不同和辅助其外交政策的需要,灵活运用各种手段,包括双边磋商,外交斡旋,法律手段等,并且做出一定的妥协甚至放弃。美国处理海洋争端的思路和方法对我国处理南海问题和周边关系问题有很好的借鉴意义。
[Abstract]:The United States faced numerous maritime disputes in the 20 th century, involving a wide range of geographical areas. This includes not only the traditional territorial disputes, but also the new type of maritime disputes which are accompanied by the changes of the international law of the sea and the rezoning of the global sea area. In dealing with these maritime disputes, the United States has demonstrated a clear strategic vision of the oceans. The United States is firmly in control of the islands, reefs and sea areas that are crucial to its strategic location. On other relatively minor maritime disputes, the United States flexibly uses various means, including bilateral consultations, diplomatic mediation, legal means, and so on, according to the differences in the object of dispute and the need to assist its foreign policy. And make a certain compromise or even give up. The ideas and methods used by the United States to deal with maritime disputes are of great significance for China to deal with the problems of the South China Sea and its peripheral relations.
