中日监护制度比较研究

【摘要】：作为一项古老的法律制度,监护在现代民法上着有非常独特的功能与价值。它一方面起着保护被监护人的基本权利的作用,另一方面又起着维护社会稳定的作用,在保护行为能力欠缺者的合法权益方面有着不可替代的价值。伴随着社会的进步与人权意识的深入发展,监护制度的功能和价值已逐步确立为以保护被监护人的利益为核心。本文主要介绍了我国与日本现行监护制度的基本内容,包括未成年人监护制度与成年人监护制度,并将我国的监护制度与日本的监护制度进行了大概的比较,以期望从中发现我国监护制度的不足之处,并借鉴日本较为先进的监护立法来完善我国的监护制度。本文分为四个部分,第一部分是:中日监护制度体系的比较,分别介绍了我国和日本的监护制度体系,并进行了对比评析,提出了我国在制度体系方面的不足;第二部分是:我国与日本的未成年人监护制度比较研究,主要阐述了我国及日本现行未成年人监护制度的基本内容,以及我国未成年人监护制度在监护类型、监护与亲权的关系、父母离婚后对监护权的享有等问题上与日本未成年人监护制度的差异;第三部分是:中日两国成年监护制度的比较研究,通过对中日两国成年监护制度在监护理念、监护类型、监护人的选任、监护人的监护职责等方面的比较,分析我国在成年监护制度方面的不足。第四部分是:日本监护制度对我国以后的监护立法有哪些启示,并期望我国在今后的监护立法中积极借鉴日本比较先进的立法经验与立法理念,使我国的监护制度更加完善。
[Abstract]:As an ancient legal system, guardianship has a very unique function and value in modern civil law. On the one hand, it plays the role of protecting the basic rights of the ward, on the other hand, it plays the role of maintaining social stability, and it has irreplaceable value in protecting the legitimate rights and interests of the incapacitated. With the progress of society and the further development of human rights consciousness, the function and value of guardianship system has been gradually established to protect the interests of the guardian as the core. This paper mainly introduces the basic contents of the current guardianship system between China and Japan, including the guardianship system of minors and adults, and makes a general comparison between the guardianship system of our country and the guardianship system of Japan. The author hopes to find out the deficiencies of the guardianship system in China, and use Japan's more advanced guardianship legislation for reference to perfect the guardianship system in our country. This paper is divided into four parts, the first part is: the comparison of the guardianship system between China and Japan, respectively, introduced the guardianship system of China and Japan, and made a comparative analysis, put forward the deficiencies in the system of our country; The second part is: our country and Japan minor guardianship system comparison research, mainly elaborated our country and the Japan present minor guardianship system basic content, as well as our country minor guardianship system in the guardianship type, The relationship between guardianship and parental power, the rights of custody of parents after divorce, and the differences between the guardianship system of minors in Japan and those in Japan. The third part is the comparative study of the adult guardianship system between China and Japan. Based on the comparison between Chinese and Japanese adult guardianship systems in terms of guardianship concepts, types of guardianship, selection of guardians, guardianship duties and so on, this paper analyzes the shortcomings of China's adult guardianship system. The fourth part is: what enlightenment does the Japanese guardianship system have to the future guardianship legislation of our country, and expect our country to draw lessons from Japan's more advanced legislative experience and legislative idea actively in the future guardianship legislation, make our country's guardianship system more perfect.
