美国专利法最新修改及其对中国的借鉴研究

【摘要】：美国在建国之初是非常落后的农业国,但美国的创立者们很早就认识到科技创新对国家进步的重要性以及专利制度对科技进步的重要性,故在美国最早制定的宪法中就确立了建立专利制度的内容。此后,美国的专利制度一直伴随着美国的成长,见证了美国从落后的农业国变身为世界头号经济强国、科技强国。美国的专利制度经过二百多年的发展,已经形成相当完备的体系,成为各国学习的对象。 2009年9月16日,美国总统奥巴马签署了《美国发明法案》(America Invents Act, AIA)。这部法案是自1952年以来,美国专利制度最彻底的变革,有望在全球经济停滞不前的情况下,专利法的改革能再一次激起创新热潮,刺激经济增长。我国的专利制度起步很晚,但发展迅猛,为我国的经济发展作出了重要贡献。此时正值经济转型之际,国家欲创建创新性国家,更需要合适有效的专利制度保驾护航。本文着重对AIA的内容进行述评,希望从中吸取有用经验,为我国的专利制度发展做出贡献。本文分为三个部分：第一章是美国专利法概述,主要介绍美国专利制度的起源和发展。第二章是AIA内容述评,介绍美国发明的主要框架和内容：第一部分介绍AIA的主要框架。第二部分重点介绍美国设立的“先申请制”。第三部分重点介绍美国新设立的专利授权后异议程序。第三章是借鉴研究。主要是探讨我国专利制度的现状和存在的问题,以及完善我国专利制度的一些建议。
[Abstract]:The United States was a very backward agricultural country at the beginning of its founding, but the founders of the United States recognized early on the importance of scientific and technological innovation to the progress of the country and the importance of the patent system to the progress of science and technology. Therefore, the establishment of a patent system was established in the first constitution of the United States. Since then, the patent system of the United States has been accompanied by the growth of the United States, witnessed the United States from a backward agricultural country to become the world's largest economic power, scientific and technological power. After more than 200 years of development, the patent system of the United States has formed a quite complete system and has become the object of study in various countries. On September 16, 2009, US President Barack Obama signed the America Invents Act. The law is the most radical overhaul of the U.S. patent system since 1952, and is expected to spark another wave of innovation and economic growth amid a global economic stagnation. The patent system of our country starts very late, but develops rapidly, which has made important contribution to the economic development of our country. At a time of economic transition, the country needs a proper and effective patent system to create an innovative country. This paper focuses on the content of AIA, hoping to draw useful experience and contribute to the development of China's patent system. This paper is divided into three parts: The first chapter is an overview of American patent law, mainly introduces the origin and development of American patent system. The second chapter is a review of AIA content, introducing the main framework and content of American invention: The first part introduces the main framework of AIA. The second part focuses on the introduction of the "first application system" established in the United States. The third part focuses on the new patent licensing of the United States after the objection procedure. The third chapter is the reference research. This paper mainly discusses the present situation and existing problems of the patent system in China, and some suggestions on how to perfect the patent system in China.
