论三峡库区后期扶持中农村移民权益的法律保护

【摘要】：作为举世瞩目的世纪工程,三峡工程的成败不仅在于大坝本身,更在于110多万库区移民如何能够“搬得出、安得稳、逐步能致富”。要实现这一目标,必须在目前进行的库区后期扶持工作中建立起对移民权益的法律保障制度,以回应三峡工程“开发性移民”的方针和依法开展移民工作的要求。作为三峡库区移民中的农村移民,由于其生产、生活受到的影响更大,迁后重建更加困难,表达利益诉求的渠道更加不畅,属于移民中的弱势群体,因而更加需要关注与重视。由此,需特别着眼于对农村移民的法律保障,构造相辅相成系统联动的制度体系,以捍卫其权益。针对这一问题,笔者立足农村移民权益现状,在总结国内外工程性移民权益保护经验教训的基础上,对三峡工程后期扶持中农村移民权益法律保护的制度建设进行了系统性、探索性的研究,主要包括以下三大部分: 第一部分:三峡库区后期扶持中农村移民权益保护的基本问题。笔者首先界定了三峡库区、三峡库区移民、农村移民以及三峡库区后期扶持中的农村移民权益几个概念,并明确了三峡库区后期扶持中的农村移民权益保护之权利基础,即农村移民的生存权、发展权、知情权、参与权和监督权。接下来,笔者从微观视角和宏观视角两方面出发,阐述了三峡库区后期扶持中农村移民权益保护的理论基础,即人权、公民权、社会发展与社会稳定。最后,笔者提出了三峡库区后期扶持中农村移民权益保护的应然状态,包括确立农村移民的主体地位,进行全方位的权益保护,以生存权、发展权、知情权、参与权、监督权的保护为着眼点以及构建有效的决策参与、利益表达、利益协调和利益救济机制。第二部分:三峡库区后期扶持中农村移民权益保护的现状。首先,结合实证调查,考察了三峡库区后期扶持中农村移民权益受损的表现,包括后期扶持需应对的权益受损的状况和后期扶持中产生的权益受损的状况两个层面。然后,笔者从农村移民生存权、发展权、知情权、参与权、监督权几个方面,对三峡库区后期扶持中农村移民权益保护的政策与法制作出了系统评估,明确了其中的缺陷。第三部分:三峡库区后期扶持中农村移民权益法律保障制度的构造。在制度构造的过程中,笔者运用文献分析和比较分析的研究方法,立足国内外工程性移民权益保护工作的经验教训,提出了三峡库区后期扶持中农村移民权益法律保障制度的基本理念和主要制度。对于基本原则的确立,笔者从经济法的视角出发,提出了社会本位、有限政府两大原则;另外,基本原则还包括依法后扶以及保障性与发展性并重。在主要制度的构建中,笔者提出了要着重建立以下几种制度,即后扶资金投入与管理制度、农村移民社会保障制度、农村移民培训与就业促进制度、农村移民项目扶持制度、农村移民参与、监督制度以及农村移民权益救济与法律援助制度。
[Abstract]:As the world-famous century project, the success or failure of the Three Gorges project lies not only in the dam itself, but also on how the immigrants in the 110 million reservoir area can "move to, get stable and get rich gradually". To achieve this goal, the legal guarantee system for the rights and interests of immigrants must be established in the support of the late period of the reservoir area to respond to the Three Gorges Project. As the rural emigrants in the Three Gorges Reservoir area, the rural emigrants in the Three Gorges Reservoir area are more affected by their production, more difficult to relocate, and the channels for expressing the interests of the migrants are more difficult, and they belong to the disadvantaged groups in the immigrants. Therefore, it is necessary to pay more attention and attention. Special attention should be paid to the legal protection of rural migrants, and a system of complementary and systematic linkage should be constructed to safeguard their rights and interests.
In view of this problem, based on the status of rural migrants' rights and interests, on the basis of summarizing the experience and lessons of protecting the rights and interests of migrant workers at home and abroad, the author makes systematic and exploratory research on the legal protection of the rights and interests of rural emigrants in the later stage of the Three Gorges project, which mainly includes the following three parts:
The first part: the basic problems of the protection of the rights and interests of the rural emigrants in the later stage of the Three Gorges Reservoir area. First, the author defines several concepts of the Three Gorges Reservoir area, the Three Gorges Reservoir area immigrants, the rural emigrants and the later support of the Three Gorges Reservoir Area, and clarifies the rights basis of the protection of the rural migrants in the later stage of the Three Gorges Reservoir area. The right to subsistence, the right to development, the right to know, the right to participate and the right to supervise the rural migrants. Then, from the two aspects of the micro and macro perspectives, the author expounds the theoretical basis for the protection of the rights and interests of the rural migrants in the late stage of the Three Gorges Reservoir area, namely, human rights, civil rights, social development and social stability. Finally, the author puts forward the support of the Three Gorges Reservoir Area in the late period. The protection of the rights and interests of the rural emigrants, including the establishment of the main status of the rural migrants, and the full protection of rights and interests, with the right to survival, the right to development, the right to know, the right to participate, the protection of the right to supervision, and the construction of effective decision-making participation, interest expression, benefit coordination and benefit relief mechanism.
The second part: the status quo of the protection of the rights and interests of the rural migrants in the late stage of the Three Gorges Reservoir area. First, the performance of the damage of the rights and interests of the rural migrants in the late support of the Three Gorges Reservoir area is examined by an empirical investigation, including the two levels of the damage to the rights and interests of the late support and the damage of the rights and interests produced in the later support. Then, the author The rural emigrants' right to survive, the right to development, the right to know, the right to participate, and the power of supervision, make a systematic assessment of the policy and legal system of the protection of the rights and interests of the rural migrants in the late stage of the Three Gorges reservoir.
The third part: the construction of the legal guarantee system for the rights and interests of the rural migrants in the later period of the Three Gorges Reservoir area. In the process of the system construction, the author uses the research methods of literature analysis and comparative analysis, and based on the experience and lessons of the protection work of the engineering emigrant rights at home and abroad, and puts forward the legal protection of the rights and interests of the rural migrants in the late support of the Three Gorge Reservoir area. The basic principle of the system and the main system. On the basis of the basic principles, the author, from the perspective of economic law, puts forward two principles of social standard and limited government. In addition, the basic principles include the legal support of the law and the balance between the security and the development. In the construction of the main system, the author puts forward to establish the following several systems, That is, capital investment and management system, rural emigration social security system, rural emigrant training and employment promotion system, rural emigrant project support system, rural emigrant participation, supervision system and rural emigrant rights and interests relief and legal aid system.
