美国主权债务危机的生成机理与法律应对

【摘要】：美国爆发的主权债务危机显示出美国在主权债务监管法制中的重大缺陷,危机产生和处置的整个过程中,主权债务监管法制并未发挥出应有的控制主权债务风险、维护投资者权益的作用。美国债务危机的法律成因是因为其《预算平衡法案》和《债务限额修正案》监管失灵导致的,并可能导致直接或隐性违约的现象产生。对于债务危机的应对美国主要采取财政平衡修正案以及债务负担的转移,但其应对效力是值得商榷的,其可能损害投资者权益。中国应该意识到美债危机可能对中国带来的风险,构建有效的应对机制,降低债务危机对中国造成的冲击。
[Abstract]:The sovereign debt crisis in the United States shows that the United States has a major defect in the legal system of supervision of sovereign debt. During the whole process of the emergence and disposal of the crisis, the regulatory system of sovereign debt did not play its due role in controlling the risk of sovereign debt. The role of protecting the rights and interests of investors. The legal cause of the debt crisis in the United States is due to the failure of its "Budget balance Act" and "debt limitation Amendment" regulation, and may lead to direct or implicit default. To deal with the debt crisis, the United States mainly adopts the fiscal balance amendment and the transfer of the debt burden, but its response effect is open to question, which may damage the rights and interests of investors. China should be aware of the risks that the U.S. debt crisis could pose to China and build an effective response mechanism to reduce the impact of the debt crisis on China.
