【摘要】：立法听证是立法民主的实践。立法听证制度为普通公民参与立法提供了途径,在立法活动中协调立法机关与公民的关系。近几年,我国公民参加立法听证的实例逐渐增多,但无论在理论上还是在制度建构上,立法听证参加人制度仍存在诸多问题。本文以我国立法听证制度的背景为切入点,探讨我国的立法听证的性质和功能,从理论和实践分析立法听证参加人制度的现状与不足,在此基础上提出完善我国立法听证参加人制度的建议。本文分为五个部分：第一部分是引言,主要介绍我国立法听证的社会背景,此部分是本文的基点,论述了立法听证在我国存在的必要性；第二部分首先论述了我国需要什么样的立法听证,确定我国立法听证的性质和功能。并在此基础上界定我国立法听证参加人的概念；第三部分国外立法听证参加人制度借鉴。由于资料有限,选取了美国、德国、加拿大,虽然三个国家在政治体制上属联邦制国家,但在立法听证参加人制度的细微之处存在不同；第四部分从理论和实践角度介绍了我国立法听证参加人制度的现状与不足；第五部分提出了完善我国立法听证参加人制度的建议。
[Abstract]:Legislative hearing is the practice of legislative democracy. The system of legislative hearing provides a way for ordinary citizens to participate in legislation and coordinates the relationship between legislative organs and citizens in legislative activities. In recent years, the number of citizens participating in the legislative hearing has gradually increased, but there are still many problems in the system of the participants in the legislative hearing, both in theory and in the construction of the system. Based on the background of the legislative hearing system in China, this paper probes into the nature and function of the legislative hearing in our country, and analyzes the present situation and deficiency of the legislative hearing participant system in theory and practice. On this basis, the author puts forward some suggestions on how to perfect the system of the participants in the legislative hearing in our country. This article is divided into five parts: the first part is the introduction, mainly introduces the social background of our country's legislative hearing, this part is the basic point of this article, has discussed the necessity of the legislative hearing in our country; The second part first discusses what kind of legislative hearing our country needs, determines the nature and function of our country's legislative hearing. On this basis, it defines the concept of the participants in the legislative hearing in our country; the third part draws lessons from the system of the participants in the foreign legislative hearings. Because of the limited data, the United States, Germany and Canada are selected. Although the three countries belong to the federal system in the political system, there are differences in the nuances of the system of participants in the legislative hearings. The fourth part introduces the present situation and deficiency of the system of the participants in the legislative hearing in our country from the angle of theory and practice, and the fifth part puts forward some suggestions on how to perfect the system of the participants in the legislative hearing in our country.
