我国法治型政商关系的建构路径探赜

【摘要】：政商关系对于任何国家来说都是客观存在的,并且随着历史发展而转型变革。当前,我国经济进入新常态,政商关系领域存在的诸多问题严重制约着我国法治化建设的推进:规范政商关系的制度建设滞后,且现有制度的执行力不强;政府和市场边界不清,行政力量对企业的干预仍然较大;对政府权力的制约和有效监督机制缺失等。伴随改革的深入,要从完善和创新法治型政商关系的法律和制度基础、厘清权力边界、织密监管网络、努力营造法治型政商关系氛围等方面入手,重塑政商关系新生态,构建具有中国特色的法治型政商关系。
[Abstract]:The relationship between government and business is an objective existence for any country, and changes with the development of history. At present, our country's economy has entered a new normal state. Many problems in the field of political and commercial relations seriously restrict the promotion of the construction of the rule of law in our country: the system construction of regulating the relationship between government and business is lagging behind, and the execution of the existing system is not strong; the government is not strong; And the market boundary is not clear, the interference of the administrative force to the enterprise is still larger, the restriction of the government power and the lack of effective supervision mechanism. With the deepening of the reform, we should improve and innovate the legal and institutional basis of the relationship between the rule of law and business, clarify the boundary of power, supervise the network, and strive to create the atmosphere of the relationship between the rule of law and business. To rebuild the new ecosystem of the relationship between government and businessmen and build a rule of law relationship with Chinese characteristics.
