纠纷与法律纠纷及相关概念的辩证探析

【摘要】：纠纷是社会学概念,法律纠纷是法学概念,矛盾、争执、争议和冲突是与纠纷相关的概念。这些概念都用来描述权利义务失衡这样一种社会现象;但是,描述的状态和剧烈程度不同,矛盾描述处于内隐状态的社会现象,争执、争议、纠纷和冲突描述处于外显状态的社会现象;矛盾的剧烈程度最弱,冲突的剧烈程度最强,纠纷处于从争执、争议向冲突的过度阶段。
[Abstract]:Disputes are sociological concepts, legal disputes are legal concepts, contradictions, disputes, disputes and conflicts are related to disputes. These concepts are used to describe a social phenomenon, such as the imbalance of rights and obligations; however, the state and intensity of the description are different, and contradictions describe social phenomena, disputes and disputes in an implicit state. Dispute and conflict describe the social phenomenon in explicit state; the intensity of contradiction is the weakest, the intensity of conflict is the strongest, and the dispute is in the transitional stage from dispute to conflict.
