德法共治的学理探析——兼论德法共治在首都公共文明建设中的意义

【摘要】：道德和法律作为现代社会规范体系的两种最为重要的形式,在维系人们的社会交往和国家有效运转中共同发挥着重要作用。作为两种社会治理模式,德治与法治之间既相互差别,又相辅相成、互相补足。德法共治成为古今中外共同认可的社会治理模式,具体而言,德主刑辅成为中国传统社会德法共治的基本治理模式,而法主德辅成为西方现代社会德法共治的基本治理模式。作为社会进步、社会文明的一个重大标志,德法共治不仅为城市公共文明建设及城市治理提供了政策依据,也为加强北京城市公共文明建设、缓解交通拥堵、环境污染等城市发展难题提供了理论和现实借鉴。
[Abstract]:As the two most important forms of modern social norm system, morality and law play an important role in maintaining people's social communication and the effective operation of the country. As two modes of social governance, the rule of virtue and the rule of law are different and complement each other. The combination of morality and law has become a common social governance model in ancient and modern times. In particular, the principle of morality and punishment has become the basic mode of governance in Chinese traditional society, while the rule of law and law has become the basic mode of governance in modern western society. As a major symbol of social progress and social civilization, Germany and France not only provide a policy basis for the construction of urban public civilization and urban governance, but also strengthen the construction of urban public civilization in Beijing and ease traffic congestion. Environmental pollution and other urban development problems provide theoretical and practical reference.
