先秦法家人性论及其现代批判

【摘要】：先秦法家人性论不仅是法家学说构建的基础,更能将其与先秦其余各家学说区隔开来。虽然法家代表人物众多,观点不尽相同,但其人性论贯彻始终,并体现在法家政治思想论述和由法家主导的各国变法实践中。从历史角度看,由法家人性论延伸的政治思想及其政治实践,客观上有利于富国强兵,巩固君主权威,强化中央集权,并在事实上促进了秦的统一。但就其根本,还是为君主专制服务的,与现代法治精神即权力受到有效限制是相背离的,我们要以批判性的眼光,面向现代法治国家,重新诠释法家的人性论。
[Abstract]:The theory of human nature of Legalists in pre-Qin Dynasty is not only the foundation of the construction of Legalism, but also can be separated from other doctrines in pre-Qin Dynasty. Although there are many representatives of Legalists, their views are different, but their theory of human nature is always reflected in the political thoughts of Legalists and in the practice of reform in various countries dominated by Legalists. From the historical point of view, the political thought and political practice, extended by the theory of human nature of the Legalists, are objectively conducive to the prosperity of the country, the consolidation of the authority of the monarch, the strengthening of the centralization of power, and in fact, the unification of the Qin Dynasty. However, it is contrary to the modern spirit of ruling by law that the power is effectively restricted. We should look critically at the modern country ruled by law and reinterpret the theory of human nature of the Legalists.
