【摘要】：在司法审判中,对事实的证明是审判当中重要的一个环节,而检验正是对涉审判案件中的专门性问题提供答案和证据,司法检验制度也由此应运而生。宋代是我国古代司法检验制度发展的鼎盛时期。宋代的司法检验制度在继承唐代的司法检验理论和实践成果的基础上,无论是在法律层面上,还是在理论实践上,与前代相比有着巨大的飞跃。并且司法检验制度的发展也带动了相关的检验技术的提高,更产生举世闻名的检验著作《洗冤集录》,将司法检验带到了新的高度。第一章主要分析了宋代司法检验制度之所以能取得如此巨大的成就,除了继承了前代的法令和制度外,与宋代商品经济的发展,文化的繁荣等大环境的影响也是密不可分的。第二章分析了宋代的司法检验制度的整体内容,其有了贯穿整个检验制度的指导性原则,明确了检验主体的组成,检验范围也随着检验技术的发展而扩大,而检验时所遵循的程序规则以及记录检验过程的文书都有着相应的律文支持,达到了我国司法检验史的顶峰。第三章分析了宋代司法检验制度的特点。与前代相比,不仅是数量上相关检验法令得以增加,对于检验人员,也制定了一系列的责任制度,检验文书的标准也得到了统一。第四章分析了宋代的司法检验制度产生的影响。器不仅对附近国家检验技术的发展影响深远,而且为后世司法检验制度的发展打下了良好的基础,其相关的司法检验技术、检验文书的格式等在元清时期被一并吸收并发扬光大。
[Abstract]:In the judicial trial, the proof of fact is an important link in the trial, and the test is to provide the answer and evidence to the specialized question in the trial case, the judicial inspection system also arises at the historic moment. The Song Dynasty was the heyday of the development of judicial inspection system in ancient China. On the basis of inheriting the theory and practice of judicial inspection in the Tang Dynasty, the system of judicial inspection in Song Dynasty has made a great leap compared with the previous generation, whether on the legal level or in the theoretical practice. And the development of the judicial inspection system has also led to the improvement of the relevant inspection techniques, and has produced the world-famous inspection book "Collection of the Wash of grievances", which has brought the judicial inspection to a new height. The first chapter mainly analyzes the Song Dynasty judicial inspection system can make such great achievements, in addition to inheriting the previous laws and systems, and Song Dynasty commodity economy development, cultural prosperity and other environmental impact is inseparable. The second chapter analyzes the whole content of the judicial inspection system in Song Dynasty, which has the guiding principles running through the whole inspection system, defines the composition of the inspection subject, and expands the inspection scope with the development of the inspection technology. The rules of procedure and the documents of recording the inspection process are supported by the corresponding rules, which reach the pinnacle of the history of judicial inspection in our country. The third chapter analyzes the characteristics of the Song Dynasty judicial inspection system. Compared with the previous generation, not only the quantity of relevant inspection laws have been increased, but also a series of liability systems have been formulated for inspectors, and the standards of inspection instruments have also been unified. Chapter four analyzes the influence of the judicial inspection system in Song Dynasty. The instrument not only has a profound influence on the development of inspection technology in nearby countries, but also lays a good foundation for the development of judicial inspection system in later generations. The format of the inspection document was absorbed and carried forward in the Yuan and Qing dynasties.
