俄罗斯联邦情报法制建设及其特点

【摘要】：[目的/意义]俄罗斯联邦已经形成了以宪法为立法依据,以安全法为立法基础,以若干纲领性文件为立法的政策指导和理论依托,以情报领导机构和情报机构法律、法规及规章为立法支撑的情报立法体系。认真研究并吸收俄罗斯情报立法的经验,有助于引导我国科学制定情报立法规划,把握立法的完整性,完善情报安全立法框架。[方法/过程]通过研究俄罗斯联邦建国之后颁布的各项情报法律法规,梳理了俄联邦情报立法的历程及结构体系,并对其主要内容和功能做出了评析。[结果/结论]提出了有关情报立法的相关建议,为中国进行情报立法提供了启示,有助于促进中国情报法制建设。
[Abstract]:[Objective / significance] Russian Federation has formed a legal system based on the constitution as the legislative basis, the security law as the legislative basis, a number of programmatic documents as the guidance and theory of the legislation, and the legislative support of the intelligence leadership and intelligence agencies, laws and regulations as the legislative support, and the careful study and absorption of Russian intelligence legislation. The experience is helpful to guide our country to make scientific planning of information legislation, grasp the integrity of the legislation, and improve the legislative framework of information security. Through the study of the information laws and regulations issued after the founding of Russian Federation, the course and structure of the Russian Federal intelligence legislation have been combed, and its main contents and functions are made. [results / conclusions] put forward relevant suggestions on information legislation to provide inspiration for China's intelligence legislation and help promote the construction of China's intelligence legal system.
