功能主导型立法观的确立与作用——基于人权保护和公权力的限制

【摘要】：在当下中国转型时期,司法中对于"良法"的追求,实际上是在探寻如何完善立法的问题。形式主导型立法与功能主导型立法,两者在思想渊源、立法形式、认识论与价值论以及对后期法学影响等方面均存在差异,但受时代的影响,现代国家立法正发生着实用主义转型,基于人权保护和制约公权的需要,逐步从侧重完善法律形式转向兼顾法的适用功能,从单纯注重立法的形式规范性特征向注重立法的实质正义与社会需求转变。这种实用主义的立法思潮对中国的法治转型产生了积极影响,推动了立法对人权的保护、对民间法入法的重视以及立法方法论自身的发展。
[Abstract]:In the transitional period of China, the pursuit of "good law" in the judicature is actually exploring how to perfect the legislation. There are differences between form-dominated legislation and function-dominated legislation in the aspects of ideological origin, legislative form, epistemology and value theory, and their influence on later jurisprudence, but they are influenced by the times. The modern national legislation is undergoing a pragmatism transformation. Based on the need of protecting human rights and restricting public rights, it has gradually changed from focusing on perfecting the legal form to giving consideration to the applicable function of the law. From a simple focus on the formal normative characteristics of legislation to focus on the substantive justice and social needs of legislation. This kind of pragmatic legislative trend has had a positive impact on the transformation of the rule of law in China, and has promoted the protection of human rights by legislation, the importance attached to the introduction of folk law and the development of the legislative methodology itself.
