论民主之合法性与现代法律之科学基础

【摘要】：在西方法哲学发展的历史长河中,法律作为人类意志的表达,其合法性基础颇有争议。在西方法学界,法律尤其是实证法的合法性基础概而言之有三种叙事方式:一是实证法必须符合作为高级法背景之自然法才使其具有了合法性基础;二是法律合法性源于主权者,在此之主权者既可是君主也可是人民;三是借助自然科学的实证研究方法,把法律科学作为社会科学之组成部分,提出现代法律必须具备科学性基础才使其具有合法性。因此,有待我们探究的问题是,现代民主应如何赋予法律尤其是实证法以合法性,具有正当性之法律的科学基础是什么以及现代民主下的法律与正义之间的关系如何。
[Abstract]:In the history of the development of western philosophy of law, the legal basis of law as the expression of human will is controversial. In the western legal circles, there are three kinds of narrative methods about the legal basis of the law, especially the positive law: first, the positive law must conform to the natural law as the background of the advanced law in order to make it have the legitimacy foundation; Second, the legitimacy of law originates from the sovereign, in which the sovereign may be the monarch or the people; third, the legal science is regarded as an integral part of the social sciences with the help of the empirical research methods of the natural science. It puts forward that modern law must have scientific foundation to make it have legitimacy. Therefore, the question to be explored is how modern democracy should give legitimacy to law, especially positive law, what is the scientific basis of legitimate law and the relationship between law and justice under modern democracy.
